My husband is Dominican and has a two year old daughter. The mother is from a very poor neighborhood and the living condiitions are dirty. The daughter is always catching something and needs medical attention. She has had parasites both on her skin and internally several times. She has recently had a infection in her knee and the doctor contributes it to the fact that she has a lot of little sores on her legs from bites etc.

My husband want us to take custody of her. so far the mother will not even allow over night visits and we are going to the fiscal to have that changed now that she has turned two.

The mother has never really worked and sits at her fathers house all day looking for reasons to call us to take the girl somewhere at which time she gets an outing.

Is it possible to make a case and win custody, we live in a large house and have the means to take care of her properly. but the mother will fight this as she likes the money so she doesn't have to work. We only buy what the baby needs but are conviced she sells some of it because she always has money for phone cards, salon etc.

The younger the child, the less likely that custody will be granted to the father.

This type of case is very difficult to win unless evidence of improper behavior, abuse, etc. can be shown in court.

On the other hand, it would be very easy to obtain frequent visitation rights, etc. that will at least keep you in the know of what's happening.
