Title insurance question for Mr. guzman

This was the subject of a thread not in the legal section and in essence the question myself and everyone else wanted an answer on was this if you would be so kind :



If one purchases Title Insurance from Stewart or First American and they get a reportedly clear title and later on someone, comes up with some bogus title that they get registered and it predates your title

Or What if the lawyer doing the research for Stewart gets duped and the real owner shows up 3 years down the line ???


Does the Title company pay you and make you whole if the title you insured with them is in anyway invalidated.

I called Stuart and I believe the representative I talked to ( a specialist) did not even know the answer.
Her reply was I'll send you a policy and you can read it. :surprised

That's customer service DR style.

The question has been asked here before, does anybody have experience with a DR title insurance company paying a claim.

I don't recall ever seeing an answer.

Usually they pay an attorney to defend the title. If the title is invalidated they should pay you the amount of the policy.

However, you should be careful with title insurance and read very closely the long list of exclusions, so as to avoid the surprise of finding out that the risk you thought was covered was in fact expressly excluded.
