Some advice needed on Divorce please, we married in Dominican Republic - husband being Dominican we both now reside in the UK we were married 6 yrs and have 2 children who he supports and property will remain in my name with him claiming no rights over it, we both agree on the divorce, he is due to go on holiday in August and has suggested to me while he is there he can sort out the divorce if I agree. I've read up on it briefly and from what I understand I get a seperation agreement made up which he takes over to the DR and gets the divorce, questions I have are how much do the official del estado civil charge and since my divorce is straight forward and uncontested would it be just as cheap to do in the UK ( I can do a DIY divorce here for about ?1000 )

I'm sorry but I would not let him "sort it out" in the DR. You will probably end up on the short end of that stick. If you can do it in the UK than by all means get it done there. You will have piece of mind and it will get done in a timely manner. The problem of trying to get it done in the DR is that if both of you are not there in person this will probably create problems in getting this matter finalized and it could end up costing you more money. Disclaimer... I'm not a lawyer... BUT... why in the world would you get a divorce in any jurisdiction other than where you reside???? You live in UK, you are governed by UK laws.... certainly you should get your divorce in UK courts, (or whatever process is used in the UK.)

hmmm... i dunno... i know a lawyer who handled a divorce of a canadian couple recently... they married here and divorced here... not sure whether it's because it was cheaper that way or whether it was more of a necessity...

If you want a quick divorce the DR is the place to get one. If you have assets and child support to deal with it's best to do it in your own country.

I known in Canada with a lawyer if the 2 of you agrees it shall cost $1000 U.S.( $500 each ) In the D.R. if the 2 agrees or not and both are using a lawyer and you have properties each lawyers will take at least 25 % of the properties value when they are sold to pay for the job done. If you go until the supreme court ,it may takes 10 years to be solve. This is as far as i known.

a swiss friend of my wife got married to a dominican lady here inthe dr, against our advice... 1 year later he wanted divorce, cos she was a greedy b...., as we had warned. She refused to divorce cos she was still waiting for documents to move over to switzerland, wouldnt answer phone and so on. My wife and I, who live here half the year, proposed to him to sort stuff out on our next trip. In the end with a lawyer friend of ours it cost like 500chf(20 000pesos) and half of that was translations for the swiss embassy, and without his wife consent(she only got notified after). That was 5 years ago, so I dont know how it is know, but the dominican officials had said, u need to pay her this and that, but with a competent lawyer u dont need to pay nothing to her.

@captnGlenn it was just an idea I just wanted more info before I said no to him, thought it was more straightforward than it appears.
Thanks for your advice, ill get it completed here can't trust him or anyone else for that matter in DR to look out for my interests seems my instincts are right ..... Shame didn't go with them in the start wouldn't be in this mess to begin with but that's another story !!!!

I know lots of foreign women who have divorced here. Having said that it was the woman who sorted it and not their Dominican husband. Only one has to be present and the cost is around RD$20,000.

By the way, I am not sure how easy it is to get divorced in the UK if you did not register the wedding there - so that is worth checking too.

As a side question about divorcing from a Dominican, if a couple (American wife, Dominican husband) was married in the D.R. and the wife got a divorce in the United States, are they technically still married in the D.R.? (I know that sounds stupid, but it seems like I read somewhere on this site that if the paperwork isn't done in the D.R. also, they are still considered married there.) Thanks.

I HIGHLY Recommend others to do the same!
It's not only a "Great Read", but an "Ah Ha" moment for anyone thinking of marrying a Dominican, of either sax!

that was before my time, thou. but if you search my first post it as as dumb as it gets, i am sure! probably something along the lines: omg, love of my life.

anyway, dominican divorce... maybe worth coming here for a short holiday. i never bothered to register my marriage back home so i truly doubt that if i ever want to divorce i would be able to do it from there...

i know that a divorce in DR after few years of marriage is very quick. literally weeks and you are done. so good luck.

To be honest Chris I'm not coming back for more I searched high and low for the answer to my question on the internet before I come onto this site, hope you had a good laugh at my expense ;-)
Now I don't really care about what I wrote back in 2005, I have no regrets and if I had of listened to you I wouldn't have my two beautiful babies so regrets I have none, lessons i learnt a lot but all I'm trying to do is move forward with my life and never look back.

You got it right when you said that you needed to protect your own best interests. Like I said in my previous post, I wouldn't trust your husband to go to the DR, without you, and to get anything finalized there. Good luck.

I remember a while back... (and for a guy my age a while could be like 30 years.. lol), there was a period of a year or two when U.S. tax law made it very advantageous for married couples, both working with no kids, to save big tax bucks by getting a divorce and filing separate tax returns as single idividuals. There were special packages to go to the D.R. for a quick vay-cay to get a divorce. The tax savings was greater than the cost for the trip. They hyped it up on the news stories at the time.

My first visit to the DR was in 1986, to get divorced.
Cost me $2,000 US, including air fare AND "Hoe"tel!
Took 2 days, and 1 night.
However, after only one night here, I "Extended"!
Became addicted to "Toto Dominicano", Y "Culo" as well!
Made the same mistake as "Blondie"!
Married a dominican, fell out of "Lust", now I hate her, more than I ever loved her, and boy did I love her "Back Then"!
That's why they say:,..."Those Who Can't "DO",..."Teach"!
Too bad we can never learn from the mistakes of those who have gone before!
