Otro caso de violacion de las normas y ese edificio esta en construccion


The Reef, localizado en la playa de Cabarete, fue construido hace 2 anos con 3 pisos y en las normas con el decreto viejo que le daba 3 pisos. Ahora mismo, hace varias semanas, el due?o del edificio, un ciudadano suizo, empez? la construcci?n del 4to piso a fuera del decreto viejo y del nuevo que dice que en el centro hist?rico se permite 3 pisos. Ese cuarto piso se esta haciendo escondido sin ruido pero esta bien avanzado. Es un oportunidad a las nuevas autoridades de turismo de intervenir para parar la obra y decidir de la sanci?n que merece el due?o del proyecto. El due?o del proyecto, tambi?n tiene una escuela de windsurfing y kitesurfing y al contrario de proteger la brisa invita a otros proyectos a construir a fuera de las normas. El tiene un vecino que hizo 4 pisos hace varios anos y seguro que se esta diciendo: Porque no puedo hacerlo si el vecino lo hizo?

One of the features that identify you as a leader is his democratic sensibility, and especially inclined to put an ear to the heart of society and its various organized sectors. In that attitude, you visited a few months Cabarete interest to know the problems that affect tourism in the area.
This time we who are writing to expose our concern recent official provisions that contradict democratic gains achieved by the local tourism community.
It is difficult to produce a consensus that adds the knowledge of technical, community interest and willingness of politicians around a land use plan; fundamental tool to harmonize the multiplicity of interests, ambitions and initiatives of investors and the traders, and encausarlas towards a common good purpose and sustainable development over time.
In Cabarete achieved this difficult task. After a long period of study and analysis of options (and an expense of millions), a group of trained technicians of the Ministry of Tourism, prepared a Draft Management Plan, and in a participatory process as discussed with community organizations , this being the origin of Presidential Decree No. 847-09 approving the Land Use Plan Municipal District Tourist Cabarete.
This plan indisputable technical bill, and oriented to the collective interest, has been torpedoed from the outset by special interests, mainly builders, whose only commitment is seeking excessive profits for their investment, and the reason for this attitude is that Plan sets limits and orders approved construction activity, from technical criteria seeking to preserve the environmental sustainability and the distinctive characteristics of Cabarete ONLY as a tourist destination with a unique profile that enshrines the ideal place worldwide to practice water sport in which the wind is essential matter. That Cabarete has lived the past 30 years.
For these reasons it was a surprise that the decree 671-12 introduce a change in the Land Use Plan Tourism Cabarete, to allow buildings of 4 levels in the Environmental Unit No.3 (Goleta), which not only affects the peculiar image Cabarete identifying as tourist community, but also produce changes in air currents in the area that would seriously damage its status as a destination to practice wind surfing and other water sports.
The decree 671-12 the proviso that the acceptance of 4 floors should be according to the regulations issued by the Ministry of Tourism to implement the management plan, and the rules say that the beachfront buildings can only be built in two levels and does not allow four levels to less than 120 meters from the high tide anywhere in Cabarete. We asked if they maintain this fundamental criterion of the decree, and if they respect the rules.
The same decree approving the plan for Cabarete states that should be reviewed after 5 years, but this review, which must be technical and public knowledge has not occurred and the time of issuing the decree had only 671-12 Elapsed 4 years. Asked What are the technical reasons justify this change?
Additionally we are concerned that this decree has sparked pressures for given decisions that would shatter the Tourism Zoning Plan, and will lead to a process that would change their condition as a destination for water sports, and its historic center characterized by small and tourist business, consonant with the special conditions of the narrow strip of sand that separates the sea from the lagoon of Cabarete, and that set us apart from the environment of large hotels and mega existing projects in other destinations.
This set of attributes are those that were successfully characterized and tourism in this community, the flow of international tourists, mainly individual has diminished by the lack of flights to the airport of Puerto Plata, a situation that will not change and make decisions to meet interests changing the attributes that made a successful Cabarete resort community.
The current profile of the historic center of Cabarete be improved while maintaining its current characteristics to serve as an attractive and complementary offering for tourism in the North Coast. Large commercial and tourist projects may well develop in future area whose environmental conditions such infrastructures resist; strategy needed to not happen as in the city of Samana, which in the seventies the State devastated the old urban structure and the buildings replaced by "modern", but in doing so also swept with the cultural that have preserved and properly treated, would be a major tourist attraction today would strengthen the supply of Samana and across the country.
Our claim for respect for territorial planning and environmental standards, is motivated by the determination to ensure the future of Cabarete. To remove any doubt, we call your attention to the many evidences that there are unobservable to the naked eye is causing serious damage in the coastal and other ecosystems, unauthorized constructions in violation of regulations and disrespect for environmental parameters . Many of these injuries can take many years to be corrected and others seem irreversible. On behalf of a development vision that kills the future, do not make decisions that just damage the tourism present and future generations.
Given these considerations, we ask: 1. To keep and observe the current Land Use Plan (Decree 847-09) 2.What are not issued new decrees of changes, check the Decree 671-12 and while this current interpretation is required to be given, 3 . to be respected regulations implementing the Land Use Plan, and 4.What any government action or review of the current Plan, is made from technical criteria and refer to the community through their organizations.
We take this opportunity to mention that the two priorities for Cabarete that we will present to you last year were linked to the Land Use Plan of Cabarete. One is the project to renovate the center of Cabarete, also prepared by MITUR / DPP, and the other is the completion of the collection system and wastewater treatment, which was a basic condition to allow residential density limits established in the Management Plan.
