Residencial administration refuses to comply

PJT has a senior neighbor, recently widowed, who has been at odds with the residencial administrator?s in a gated community and resort area over the maintenance of the street and sidewalk in front of the apartment building she lives in and administers the building for her owner son who is living and working Spain.

She has requested the residencial many times to fix a sidewalk and street area under its control in front of the apartment building. The residencial has not taken action to her demands. She has held back maintenance and water payments to the residencial to protest its inaction.

The residencial has shut off the water service to the building and refuses to open the valve until she pays all debts to the administration. The fee just to open the valve is US $400. She has a cistern servicing the building. The residencial administration is even refusing the entry of water trucks to fill the cistern. She will lose her tenants and income.

She had checks made to pay in full to the administration for all back maintenance and water services, to exclude the month of February. The administration still refused to accept payment. This was even after she had been to the fiscal twice and the alguacil (sheriff) brought orders and payment to them. They still refused to accept payment or comply with the orders. The fiscal said that if a third order is sent to comply and the administration refuses to comply there will be heavy penalties.

She has brought the checks to the ?treasury? in Higuey to hold in trust; this is to show is she desires to comply with payment demands of the residencial administration.

The agenda is the residencial administration wants bully her to bring all documents regarding ownership and title to the building so they can decide if the owner is legal and then make a new contract of service. They will provide water service only when a new contract is made.

The residencial administration wants her to pay for all fees, to include the reconnection and legal fees they have suffered. Yet, they have a house lawyer on site on the payroll.

This administration behavior is suspect as she believes and fears there is an agenda of using the documents or lack of documents to attach the property.

I assume the residencial is under condominium rules. What do the rules say? Is there a provision in the budget for fixing the street? Has the matter being brought to the attention of the general assembly of the condominium?
