Access to Government Information

Fabio, I am reading Law 200-04, Ley General de Libre Acceso a la Informaci?n P?blica, with a view to determining just what type of information citizens or NGOs can solicit from the Dominican government regarding environmental issues. In many countries an effective tool of citizen enforcement in environmental affairs is access to information held by the government in the form of reports, industry records, monitoring data, and information on the status and development of administrative proceedings, decisions, permits, setting emission limts, etc. Do you see any specific limitations posed by Law 200-04 on interested citizens and NGOs getting this sort of information out of the Environment Ministry and other Ministries handling sectors with environmental impacts, such as Tourism and Industry?

There is no single website. There should be, especially since the Dominican government does not publish an official gazette like most countries do. For environment laws and regulations, you can try either the Ministry's site [www.ceiba.gov.do/2004/legislacion/esp/legisla_esp.html] or the Dominican page of the law/reg text section of my website [http://www.temasactuales.com/laws_policies/legislation_Dominican Repub.html ]. The update of my website, hopefully up soon, will include a copy of the new Consumer Protection Law. For the presidential decrees since 21 Aug. 2004, go to [http://www.presidencia.gov.do/frontend/decretos.php]. The Constitution and a handful of laws (doesn't seem to be rhyme or reason to the list) can be found at the webpage of the Supreme Court, [http://www.suprema.gov.do/novedades/sentencias/wleyes.htm].
