title transfer help

We are trying to transfer the contract for the purchase of a pre-construction condo in Las Terrenas. The developer is not approving transfers at this stage of the project. The original buyer needs to sell his interest and we want to take it over. Is there any way we can "assume" his payments and replace him on title in Dominican law without necessarily getting the blessing of the developer? Is there such a thing as "quit claiming" a title/deed in the DR?

Most probably the developer does not have a Certificate of Title to your condo unit yet.

You may assign the rights you have in the condo to a third party, unless your contract with the developer expressly states the contrary.

Thank you Sr. Guzman, for all the help you are giving all of us!

It appears that the developer is restricting the actual "transfer" of title once the contracts are signed. But is it possible in the DR, once you have entered into a purchase agreement, to either add another person/partner to your title, or to form a new corporation as the ownership entity (if the developer allows that) then possibly sell the interest of the corporation?

Again, this is usually possible. However. if the developer expressly inserted a clause in your contract stating otherwise, you won't be able to do it unless he/she releases you from the clause later on.
