Here is the situation:
My dominican husband I think is being played by his ex-wife (who has both Dominican and US citizenship). They had a son together while married. Their son was born in Puerto Rico for the obvious reason of getting US citizenship. They divorced and she left to llve in PR with their son. He has not seen his son since May 2007 when he was 3yrs old. Barely, can get to speak to him on the phone but once or twice a month.
Now, the ex-wife wants him to sign the DS-3053 form "Statement of consent or special circumstances: Issuance of a passport to a minor under age of 16". This form needs to be signed by a notary. She told him to have it signed and returned to her. If he doesn't, she threatened to have his last name removed from her son's name.
Questions:
1) Can the form be legalized by a dominican notary or does it need to be legalized at the US Embassy? If a dominican notary can do it, how much ?$ can it cost?
2) Does my husband have any legal recourses here in the DR to oblige his ex-wife to let him see his son?
3) Can she remove his name from her son's name?
Any feedback on this issue would be greatly appreciated...
