Federal government delays plan to forcibly confine travellers after public backlash and threat of litigation

Feb 5th, 2021

The Justice Centre is pleased that the Trudeau government is delaying its plan to charge returning travellers $2,000 for forced hotel quarantine, in response to public backlash and the threat of litigation.
Since late January, the Justice Centre has received hundreds of emails from concerned Canadians who travelled abroad to receive emergency medical treatment, to care for dying family members, to attend funerals, to study abroad for school, or who had business or other personal reasons for travel.
On January 29, 2021, the Justice Centre announced that immediate legal action is being prepared against the Trudeau government over the declaration that Canadian residents will be subjected to mandatory quarantine, at their own expense, after returning from international travel, regardless of their negative Covid status. These measures are a blatant violation of the Canadian Charter of Rights and Freedoms, including the right to enter and leave Canada, the right to liberty and security of the person, the right to not be arbitrarily detained or imprisoned, the right to retain legal counsel, and the right not to be subjected to cruel and unusual punishment.
In a letter sent to the Honourable Omar Alghabra, Minister of Transport, the Justice Centre condemned the Trudeau government for its disturbing and aggressive opposition to the constitutional rights and freedoms of Canadians.

Explains a lot!
The Justice Centre for Constitutional Freedoms is a Canadian legal advocacy organization specializing in Canadian constitutional law, specifically in the Canadian Charter of Rights and Freedoms. The organization describes itself as non-partisan but it has partnered with several right-wing backers in the United States.

They are desperately trying to create a narrative to show that they have succeeded in making the government change course.

On January 29 when these measures were announced, Trudeau said it would take weeks to implement.
He repeated this on Feb 2 and then a few days later JC claims that they have succeeded in causing a delay, which makes no sense.
The government has yet to announce a start date.

As for the public response, it is not major backlash, it is the opposite, major support.
Again a ludicrous claim.
If anything, the public response has encouraged the government to proceed.

The government expected some to oppose these measures so the threat of litigation was totally expected.
To claim that this was a shock and caused the government to change course is again ridiculous.

If these measures are not in place by March, then it would be reasonable to suggest that there has been a delay, not that it has anything to do with JC.

Is that legal in Canada?
That is how it's supposed to work. Quarantines aren't any good if those involved are allowed to wander around to infect people. There are lots of phone calls and visits from the local authorities.

He flouted the new restrictions but they are not laws enacted by parliament. They are conditions enacted by policy. Not worth a monkey’s fart in court. People will fall through the cracks. Tracking and testing tens of thousands of people coming in from different countries and dispersing across Canada is a logistical nightmare. The government has been mismanaging all aspects of the pandemic response. This is just another example.

The news releases by Transport Canada on the new restrictions were filled with weasel words, especially the section referring to the implementation of the Covid concentration camps. Trudeau got pushback from his own cabinet and house members on the concentration camp issue. He is now getting pushback from legal rights groups and Canadian citizens on the concentration camps. The news releases were purposely worded to allow the government to delay implementation
( which they have done) and weasel out of a bad situation by implementing less stricter requirements. The isolation requirements prior to the latest restrictions were adequate to cope with returning Canadian international travellers. The Covid concentration camp threat was pure fear mongering on the part of the Federal government and they overstepped their Constitutional boundaries. I spent 38 years working with the Federal government. I wouldn’t trust them to organize a four man rush on a three hole outhouse. Tourism will continue to flow in and out of the DR. Part of that flow will be Canadian tourists. You can’t keep a good country down!

Doesn’t matter what their political affiliation is, their focus is Canadian Constitutional law, our Charter of Rights and Freedoms. The Rights and Freedoms brought back from Britain to Canada by Pierre Trudeau and now infringed on by his capricious son, Justin. Irony at it’s best.

The Canadian airlines flying into the DR from Canada weren’t stupid. They shut down for three months and the government lines their pockets. Traffic was down anyway and they were tired pleading with the government for financial relief. Air Canada managed to get funding through the back door. Not surprising because they have been a government funding favourite for decades. The airlines are fully aware of the government ineptitude.

The smart ones here are the Canadian expats and tourists who have chosen to stay in the DR and watch the government circus from afar in a warm ringside seat.

The new process has been delayed.....

Don’t hold your breath for the announcement that it will be implemented - again
Bill. Some people have to be hit in the head several times with a brick before they know it’s a brick. The same people who believe the government when they say we are here to help you or the cheque is in the mail.

And the airlines.....

Air Canada said - publicly - it would not/could not issues refunds without gov’t assistance relief.

The dance of the devil.....

There has been no start date set so how can there be a delay?
What part of "weeks" is so difficult to comprehend?

There is no disputing your proof because you have none.

Other Canadian airlines have been slowly trickling out full refunds in the hope of a government bailout. I still have DR flight credits with Air Canada and West Jet and a two year time frame to use them. No big deal for me because I know I will continue my DR excursions after all the political BS has subsided. I sympathize with the people hard hit financially by the pandemic and really need their refunds.

Bill. Despite the fact that Air Canada is a private company, they sold their financial soul to the government years ago and they are still dancing with the devil. As we all know Satan takes care of his own. I miss Canadian Airlines, my favourite of the lot. They bumped me into business class and gave me free drinks of rum many times during its short lifespan.
