Property Lease Question

I represent a company that is interested in making some substantial construction improvements on land in the DR. I am researching ways to organize the operation to protect the interests of the native land owner, and the American company. In the States, we would simply create a lease agreement, representing the company's right to improve the land and retain ownership to the structure, and the land owner's right to retain the land. Usually in this type of scenario the lease terms are 99 years (with automatic renewal) with $1 consideration terms. I am curious to know if any such contractual tool exists in the DR to accomplish this goal.

You need to contact a good lawyer. Anything to do with land is full of possibilities for future problems. Guzman Ariza is a very good firm.

A $1 consideration is not sufficient under Dominican law; it would be considered a gift and taxed as such. The Civil Code provides other options such as an "enfiteusis". You should consult a real estate attorney.
