Me and my family, I am American and my wife is Dominican and our 2 kids were traveling to our home one Sunday afternoon, on June 6, 2011 when out of the blue a intoxicated motorist flew out from the side of the road and crashed into our car in our lane. Then about 60 people came running around us , half of them with Machetes and yelling and screaming at us that we killed their son, brother, friend etc. I got out of the car and helped pull him from out of our right front wheel when a policeman grabbed me and put me back in the car because a man with a machete was about to hit me from behind. Luckily we have a close ffriend Colonel Menaya who is very close to the President and he sent a special patrol to get us. Before he arrived a woman with a knife jumped in the front seat on top of my wife, they put the bloody body in the back seat on top of my screaming 6 and 8 year old and they were trying to grat me, my daughter and car keys. It was a nightmare.

We were finally escorted to our home in Las Terrenas and the next day had to go in front of the Judge in Nagua. I had 10% del ley minimum insurance and the attorney from Union Seguros they sent for me didnt do nothing. I hired another attorney and the judge told me I couldnt leave the country and had to pay some money and had to report to Nagua two times a month. Then my attorney got approval for me to go the states from June 29 till Aug 13. At the last minute she said, call me and dont come back on the 13th, things dont look good and if you return they will put you in jail. But I told her if I dont return they will confiscate our two apartments in Santo Domingo and Juan Dolio. I tolkd my attorney I found two witnesses that were there that day and one had been a drug dealer before. He told me the motorist was drugged out when he crashedd into our car. The "victim" is from a very poor community, he doesnt even have a cedula...but he has 5 attorneys working PRO BONO for him because they know I am an American and they all want to get money from me. They have never shown the condition of the man who crashed into us. They say one leg was cut off but they never show anything from a doctor. I tell my attorney to get the blood test from the hospital where he went, for it would for sure show drug and alcohol content...but she does nothing. I am afraid of returtning until I know for sure I wont be put in Jail. I fear my attorney has joined the "victims" group of attorneys to also get money from me. We are only in the states for a visit and the kids start school in August in Santo Domingo....

Please if anyone knows what I should do. My Colonel friend says they cant put me in jail. I will try to talk to our consulate before I return and I think I should go to Guzman for ideas or representation. I just dont know why they are acting like we are guilty...and I dont know why they wont accept evidence that shows the motorist was the guilty one and that my family and I are the real victims.

Damn Rick, I am soooo sorry. This sounds like a real nightmare, I don't know what I would do. I would try to get advice from a lawyer un the states who specializes in International law. I am sorry that this is happening to your family, the majority of Dominicans (notice I said majority and not ALL nor am I personally attacking any one person), the majority are cheaters, liars, and thieves. You will not resolve this as you are now merely a dollar sign to them.

I'd probably get strong representation here and the US. Get them to settle this without you being in the country. I would not step foot back here until there was an agreement and official settlement, and case closed.

No way in hell would I set foot here if there was a chance I'd do time.

Time to use your contacts, get representation from someone with your best interests in mind, maybe Fabios team could be an option with the status they hold with ex pats.

Get your cheque book out and don't be shy if you want to return.

Least of all I trust the legal system here, and so even if on paper I'd still tread gently until I was sure case was closed.

Question: are you a legal resident or have you overstayed your visa?

The car had just the minimum insurance?

Sorry to hear about this man...add this to the things Dominicans know instinctively and that foreigners don't usually think about. If you have an accident where you hit someone you NEVER stop, specially if you're unarmed. This is an easy way to get killed and frankly you were very lucky something major didn't happen to you. You just keep going until you get to the nearest police station and then and only then you should stop. It is a shame, because you could probably help the victim right then and there, but the fact is you're putting your life at risk big time by trying to do the right thing.

I know this advice is too late for you now. At this point my advice is don't come back just yet. Call Fabio Guzman's team and talk to your Coronel friend and see what he can do for you. DO NOT hire a lawyer from the same town or region where the victim is from as they'll be working together to fleece you.

I don't see how an American lawyer can do you much good. Your apartments are here.

My recommendation is to contactl Guzman's office and see if they will represent you. They are tied in with a network that includes lawyers in the US in case one there is also needed. What I don't know is whether this falls under one of their practdice areas. Guzman Ariza Law Firm in the Dominican Republic

Immediately send an email to Guzman's office explaining your situation and the urgency.

You need a heavyweight lawyer from the sound of things and who has the connections necessary to get this resolved.

On the HOME page of DR1, on the left side is a link to Guzman Ariza. I have given them lots of work, unfortunately, over several years in the Sosua area. I see that they have an office in Las Terrenas.

I was also not happy with other attorneys and went to Guzman and had them work together (3 different firms) and WITH me. Something that Dominican Lawyers are not use to doing. It became a cross check for each firm but Guzman Ariza was the primary.

I suggest that you call and make an appointment for a consultation ASAP. IF you are not comfortable with one Attorney then ask for another. IMO, YOU must be comfortable your attorney.

Huh? Where did the 60 people come from and half wielding machetes?

And why somebody with condos in Marbella, Torremar, and Las Terrenas (over 2millions dlls in property) has a carro de concho seguro de ley. the witness is a drug dealer, and his friend is a colonel who escorted him to Las Terrenas. Something sound fishy to me.

Even if it is BS, it is a scenario that reminds people the $hit they can get in, and so not a bad thread for a reminder that when on the road stay as legal as possible. I would estimate that at least 50% of foreigners who overstay the 3 month period are not legal on these roads.

Yeah just like 2 days ago gringo hit with his jeep two friends of ours who were on the bike and left from the place of accident (he was going out of Ocean Dream Plaza where was no exit) and claims that the bike crashed him! Now poor kid is in hospital with broken leg in pain for 2 days because they dont have money for operation that is 120 000 pesos! And they weren't drugged or drunk...
Stay ur ass in US or they will kill u here a-hole!

Hmm, some gringos adapt quickly.
But then, as far as I know, there is no law saying that you must stay at the scene of the accident.
And quite rightly so, as that could be the spot where you get lynched.

do not waste any time or money on local lawyers,they are only interested in extorting money from you.Go see Guzman out of Sosua to represent you and he'll get it done for you.
I cheaped out in my case in Gas Par,thought everything was taken care of 2yrs ago but they started coming after me last nov again,i've been in court 7 times had the other party not show up and still had the judge postpone it to a later date,i beleive my lawyr is behind it all to keep me paying him.Thank god nobody was injured or killed,i had insurance,the motor conch guy did'nt

This story is amazing, with its detail and drama. Is this a true story? It sounds like a screenplay, the beginnings of a movie!

If I were in the poster’s shoes, I would not return to the DR until I had a close friend thoroughly investigate the entire situation for me. Your wife could do so, no? She was not driving. You are the one on the hook, right? Key questions that need answering before returning:

-what is the condition of the “victim?”
-is there a warrant for my arrest?
-was the victim intoxicated and can you prove that?
-are there police reports of the incident?
-has fault been determined?

I also like the suggestion of settling all of this while out of the country. Get a formalized and signed settlement agreement with the “victim” before reentry.

Also, you could try and sell your property for short money.

Or, you could for another banana republic to call home.

I do not think it is a story, pretty sure its true. In fact i have seen several accidents when a gringo hits a motoconcho, or as in most cases the motococho, hit the gringo. Hundred motoconchos turn up in no time at all. And it IS the gringos fault whatever happened.

Also, never pick up an injured at the road and drive him/her to the hospital. U will probably go to jail and pay the medical bill.

Yes, it is a jungle, and therefore u will have to act like a monkey.
