Me and my family, I am American and my wife is Dominican and our 2 kids were traveling to our home one Sunday afternoon, on June 6, 2011 when out of the blue a intoxicated motorist flew out from the side of the road and crashed into our car in our lane. Then about 60 people came running around us , half of them with Machetes and yelling and screaming at us that we killed their son, brother, friend etc. I got out of the car and helped pull him from out of our right front wheel when a policeman grabbed me and put me back in the car because a man with a machete was about to hit me from behind. Luckily we have a close ffriend Colonel Menaya who is very close to the President and he sent a special patrol to get us. Before he arrived a woman with a knife jumped in the front seat on top of my wife, they put the bloody body in the back seat on top of my screaming 6 and 8 year old and they were trying to grat me, my daughter and car keys. It was a nightmare.
We were finally escorted to our home in Las Terrenas and the next day had to go in front of the Judge in Nagua. I had 10% del ley minimum insurance and the attorney from Union Seguros they sent for me didnt do nothing. I hired another attorney and the judge told me I couldnt leave the country and had to pay some money and had to report to Nagua two times a month. Then my attorney got approval for me to go the states from June 29 till Aug 13. At the last minute she said, call me and dont come back on the 13th, things dont look good and if you return they will put you in jail. But I told her if I dont return they will confiscate our two apartments in Santo Domingo and Juan Dolio. I tolkd my attorney I found two witnesses that were there that day and one had been a drug dealer before. He told me the motorist was drugged out when he crashedd into our car. The "victim" is from a very poor community, he doesnt even have a cedula...but he has 5 attorneys working PRO BONO for him because they know I am an American and they all want to get money from me. They have never shown the condition of the man who crashed into us. They say one leg was cut off but they never show anything from a doctor. I tell my attorney to get the blood test from the hospital where he went, for it would for sure show drug and alcohol content...but she does nothing. I am afraid of returtning until I know for sure I wont be put in Jail. I fear my attorney has joined the "victims" group of attorneys to also get money from me. We are only in the states for a visit and the kids start school in August in Santo Domingo....
Please if anyone knows what I should do. My Colonel friend says they cant put me in jail. I will try to talk to our consulate before I return and I think I should go to Guzman for ideas or representation. I just dont know why they are acting like we are guilty...and I dont know why they wont accept evidence that shows the motorist was the guilty one and that my family and I are the real victims.
