Hiring a Part-Time Gardener Advice

A friend has had 'help around the garden' for the past 3 years paying the same gardener on a monthly basis, cash in hand on an adhoc basis, approximately for 3-4 days work a month. He has paid him the same amount for the entire time, monthly and has also given a Navidad payment each year.
After reading a thread on 'Social Security' contributions he is concerned about liability.
Does he need to contribute to the Social Security benefit, if so can he register for Social Security NOW, or, does it have to be back dated?
Also, would termination of work/employment be an option? Does he actually work for my friend? What constitutes an EMPLOYEE?
Again, there is no 'paper-chain?; everything has been paid cash in hand without receipts.

My initial thought is this is not a full time employee. That makes a diffy-diffy.
