Need legal advice for transferring the name on a houses title

My mom built a house on a solar about 10 years ago and put the solar in my cousin's name since she wasn't in DR. The cousin is in Spain now and we want to sign the title back over to my mom. Does anyone know how this process works or can recommend somebody in Santiago to help us out with this? The house is worth about 4million and I have no idea how to go about this, every attorney I talk to has a different story.. one says it's a 2000 peso contract and the other says it is like 100k pesos + . PLEASE HELP!

Go and get a reputable lawfirm , one which is well known like the one recommended on this board all the time...

Sayanora, the cousin has no problem with signing over the title to your mother?
It's not a transfer, your mom signed the house over to your cousin. By law it's
her house(solar) now.

I would recommend going to the guacalito and getting a copy of the title and then seeing an attorney. I expect a typical Santiageuro would pay no more than US500-8000 excluding taxes.

If you want I can put you in touch with my friend Jenni (who you met the other night at my friends supermercado) who is an attorney that can do the paperwork.

You saying 500-800? sorry maybe it was a typo because 500-8000 is a crazy range :) If it's 500-800 I'll give you a call and see if I can get this moving.

US $$.:) It could be less who knows but I remember pricing something similar about 4 years ago. Just stop by the store and tell Loli you need Jenni's number and tell her you are my fren. :)

I think that first your cousin needs to sign a power of attorney so that someone here can act on her behalf!

This is done as a property sale. Taxes should be about 120,000 pesos (3% of 4 million) if the government appraisal is 4 million pesos. Otherwise, it should be 3% of the gov't appraised value.

A possible downside to the transfer: capital gains taxes. The government is finally getting around to collecting them in some jurisdictions after many years of neglect. If the purchase price was shown as 2,000 pesos, the owner will be in for a shock (29% capital gains).

I used to tell clients not to try to cheat on transfer taxes for this very reason. You save 3% now, only to pay 25+ later.
