who are the best people call when trying to call in a debt. Its like 4 months late and im kind of pi$$ed that the person keeps putting me off saying he'll pay me next month and so on. is it like a 80/20 split or is there just a fee? worst still its a gringo.

how much money are we talking about and on what basis? is there a contract? both money lenders and lawyers "buy" debts. the chunck they take depends on the circumstances. if you are hoping that 80/20 split is your favour you are wrong. it may be 50/50 or they may even take a larger portion, depending on the situation.

theres no contract i just helped him out with $10,000 dollars. he needed to return to the u.s for an emergency situation and by all accounts everything went to plan. he said he'd pay me back in august, he went to the states in june. btw he's a neighbour, nothing more, nothing less, so please dont start the sankie thing. i just want my money back, he says next month next month but i think he just thinks the debt will dissappear.hes taken me for a fool and i will get my money back.

Be careful with whom you hire. Some collection specialists will keep all your money then shake down you and the debtor. I would ask Guzman he seems relatively honest for a lawyer.

i would consult a lawyer but my understanding is that it will be nearly impossible to get it back, without a contract or any other document to support your case. i guess some money lenders could be persuasive but they will take most of that debt in order to collect. and yeah, i will add that you have yourself to blame. 10k and no contract? for me that would only fly with the family or super close friend (maybe).

try to discuss some sort of a payment plan with that dude. a 1k a month or 4 payments of 2.5k.

You must be mad, lending a neighbour $10,000. If you heavy him then is there anything stopping him moving on. $10,000 will relocate someone, and if he hasn't paid it by now then you know chances that he can or will are small. Nothing on paper, then the loan doesn't exist, you can't touch him, put it down to experience and education.

Next time don't loan money with taking title to his car or some kind of collateral.

Are there any witnesses that can attest that you lend him the money? If so, you do have a chance
and yes, you do need a lawyer.

This case needs to be settled in court.

If it was an informal loan, don't try to get it with a lawyer or debt collector. Risk is he might deny he owes you anything and you can forget about your money. Just ask it back every week, until he's tired of you, tell him to pay you 1000 every month interest free.

Well, that's how I would do it, if he says he can't pay you know , and if he is a reasonable guy (which I assume he is since you lent him USD10,000), ask him for a guarantee, a car or so and propose him to make a contract in exchange of you giving him more time.

Befriend some policia. You can have knees broken real cheap. Could probably have him incarcerated for drug possession or something along those lines. Little bit more money and u can have him permantly parked in the campo somewhere. Of course u wont ever get ur money but...

Dont loan money that u arent willing to permantly part with. Ur only recourse here is not exactly legal.

I had a good experience collecting money back on a faulty work ( yes here in th dr ), had a lawyer assign him ( tjats what the lawyer said ) for " estafe "( ?) . He than signed a debt recognition, which he paid a month overdue, just before I was going to split with an offduty policia national if u see what I mean..... ( but there again it was only 10 000 rd )

Hate to say it but those telling you to take it as a lesson learned are right. You can try and talk to this friend/neighbour see if they are willing to do a payment plan but unfortunately I think you just learned very valuable and expensive lesson. My motto is never loan more than I can stand to lose, which means I rarely if ever loan money to anyone. I will help with food, clothes, etc... but cash, rarely, I mean rarely ever.

WOW!!! WTH??? seems like your a nice person, but my God!! I can only suggest small claims court and recover at least 1/2 of it being its a max of 5,000..Hopefully he wil admit to it or its your word against his....Now, I'm the same way, always helped others when I had it etc...But if I ever got burned like this, I would do as I suggested..If I lost? the dude is gonna get a beaten period! and it would not stop until payments started coming in...Take anything for now as well..Go over there and talk with him, he's back now yes? Get something signed to a tune of 200 bucks a Month or whatever he can swing etc...Or, can he take out a loan to repay you? How was he gonna pay you back? Again, talk with him and if nothing else works, let the beating begin!! You don't need to do it either.....

PS...It also may be worth it to pay a cop to harress him and threaten him with jail...May work, but just another idea..200 pesos or so, get a cop to knock on his door..

I think you are **** out of luck. Obviously you thought he was trustworthy but lending that king of money on his word is very risky. I would go to him and have him start paying you part of it on a regular basis. If he refuses than write off the loan and have nothing to do with him or you could hire some muscle but that will cost you.

Get a lawyer to do your debt collecting! Some charge 10 or 20 percent of whatever they collect. The debtor pays them, they take their percent and give the rest to you. Other people add the lawyer fee to the debtor, making it an extra burden to the debt.
I don?t think you should give up. Just be patient, consistent and creative. I agree that you might not get ALL your money back but you will get something...........and give the other person the hard time that they deserve.

He might genuinely not have the money to pay you back of course - there must have been a way at the beginning that you were satisfied he will have the money to pay you back (he must have explained this when you paid him - that he gets money from here and there and pays you back), but that may have failed to materialize.

Let's put it in the light that he is a nice guy and just does not have the money. So in that case you should say, that's fair enough but you need some kind of collateral until if/when the money becomes available. So the title to the car or the house etc. or some formal document written by a lawyer to say you own $10k of the house etc. until he pays you back could be considered as an option. If he doesn't want to look into any of that then it's an obvious red-flag that he is giving you the run around..... (and not a nice guy !).
