    Default debt collection agency/persons

    who are the best people call when trying to call in a debt. Its like 4 months late and im kind of pi$$ed that the person keeps putting me off saying he'll pay me next month and so on. is it like a 80/20 split or is there just a fee? worst still its a gringo.

    how much money are we talking about and on what basis? is there a contract? both money lenders and lawyers "buy" debts. the chunck they take depends on the circumstances. if you are hoping that 80/20 split is your favour you are wrong. it may be 50/50 or they may even take a larger portion, depending on the situation.

    theres no contract i just helped him out with $10,000 dollars. he needed to return to the u.s for an emergency situation and by all accounts everything went to plan. he said he'd pay me back in august, he went to the states in june. btw he's a neighbour, nothing more, nothing less, so please dont start the sankie thing. i just want my money back, he says next month next month but i think he just thinks the debt will dissappear.hes taken me for a fool and i will get my money back.

    Be careful with whom you hire. Some collection specialists will keep all your money then shake down you and the debtor. I would ask Guzman he seems relatively honest for a lawyer.

    i would consult a lawyer but my understanding is that it will be nearly impossible to get it back, without a contract or any other document to support your case. i guess some money lenders could be persuasive but they will take most of that debt in order to collect. and yeah, i will add that you have yourself to blame. 10k and no contract? for me that would only fly with the family or super close friend (maybe).

    try to discuss some sort of a payment plan with that dude. a 1k a month or 4 payments of 2.5k.

    You must be mad, lending a neighbour $10,000. If you heavy him then is there anything stopping him moving on. $10,000 will relocate someone, and if he hasn't paid it by now then you know chances that he can or will are small. Nothing on paper, then the loan doesn't exist, you can't touch him, put it down to experience and education.

    Write it off in your mind, and MOVE ON.
    Next time don't loan money with taking title to his car or some kind of collateral.

    Are there any witnesses that can attest that you lend him the money? If so, you do have a chance
    and yes, you do need a lawyer.

    This case needs to be settled in court.

    If it was an informal loan, don't try to get it with a lawyer or debt collector. Risk is he might deny he owes you anything and you can forget about your money. Just ask it back every week, until he's tired of you, tell him to pay you 1000 every month interest free.

    Well, that's how I would do it, if he says he can't pay you know , and if he is a reasonable guy (which I assume he is since you lent him USD10,000), ask him for a guarantee, a car or so and propose him to make a contract in exchange of you giving him more time.

    Befriend some policia. You can have knees broken real cheap. Could probably have him incarcerated for drug possession or something along those lines. Little bit more money and u can have him permantly parked in the campo somewhere. Of course u wont ever get ur money but...

    Dont loan money that u arent willing to permantly part with. Ur only recourse here is not exactly legal.
