i spend some time wondering whether to post this thread or not but i think the time is ripe.
last week the newspapers brought out a story that the police has made about 20 thousand arrests and most of the criminals are back on the streets:

soon afterwards the jefe of PN was saying how pi**ed off the PN is because of that:

which explains why recently they shot first and then ask questions.

and today listin diario says that some of the offenders go back to prison even 15 times, for the same crimes:

i gotta say it does not look great...

Sounds like they need the "3 strikes and you're out" law in DR.

But then they'd need to build a LOT more prisons.

I hear you loud and clear about the 'shoot first and ask questions later' PN strategy.

Easy, everyone of them should be shot without questioning when they encounter them on the street again while they should sit in.

This is so ironic! The main reasons why criminals walk free is actually because of the mess police officers make at the time of the arrests, and poor investigation and follow up from the prosecution.

Of course they want to shoot first! that?s the most convenient for them. That?s a closed case, they don?t need to do any investigation or anything, no need to follow procedure, handle evidence correctly, etc.

The current Penal Procedure Code, established a series of actions from law enforcement that result in making evidence invalid. It?s been like 10 years since all this new legislation came into effect, and most officers don?t follow it or don?t know it. They?re still talking about the "New code.

Don?t even get me started on prosecutors, some actually do care about their work, but many work on particular interests and even drop cases or let cases prescribe on purpose.

At present there are about 25,500 prisoners in the jails that were designed for less than 8000.These are figures from the government and the human rights group .Of the 25500 about 85% have not been sentanced and some have not ever faced a court ,,That is more than 21000 people are in prison without a sentance .
In the case of the common criminal , the robber, the murderer, the rapist ,the innocent victim or the perpetrator of a road accident , the person is usually paraded by the police and the prosecutor reads out a police report to the judge and , as most offenders are poor , they are sent to prison for normally 3 or 6 months while the police investigate , but this time in prison goes on and on because the police have no evidence . The rich will buy there way out of prison but they will need to pay a lot to the fiscal and/ or judges .
While this scenario is going on , the police are also going out at night in pairs on a motor bike or in fours in a pick up and they raid various houses and they pick up many stolen items which they take and the delinquents are left alone for a while .
And there is yet another scenario, very common in this country with a basic Napoleonic law system , where a person may go to the police and accuse someone of raping their daughter, who even may be a prostitute or bashing someone,and so then the police go around and arrest the person who has been before told by the accuser that if he pays 100,000 pesos or so , the accuser will not go to the police..It is common blackmail and usually combined with perjury ,Again the best way is to buy yourself out even though you are innocent .
The summary is that in the normal cases , the poorer classes are in prison

I must quickly reply to why a person is in prison and then released and then in prison again....this normally relates to larceny, where the robber is working with the police .so he must be released so he can not make another robbery and so share proceeds with the police ..The entire system is rotten to the core and best advice is always to have ready money available ..100,000 to 200,000 will do the trick .

People say that these days criminals walk free way too easily from an arraignment, but actually, preventive prison is more common than ever. The prosecutor has 3 months to investigate when the person is under preventive prison, but in reality, they don?t need to use up the whole three months. Many people, unknowingly, spend the whole three months, or even more, sitting in jail waiting. This is why it?s important to have a diligent lawyer, who defends your interests. Some lawyers will just not explain anything and tell you that you just have to sit around in jail for three months. A diligent lawyer will explain you the process, ask for a revision hearing, for an appeal if necessary.

It?s not called a Napoleonic system anymore, it?s a "mixed" system now. The police can?t do that anymore, well they?re not SUPPOSED to . They can?t just go arrest you because someone showed up at the station and told them you had raped their daughter. Unless they caught you red handed, or while running away, they?d need a court order for that.
And to make that claim, someone needs to go to the fiscal?s office instead.

Fingered - if the criminal is arrested three times he thereafter is figado (not sure about the spelling) and is at high risk of 'Dominican Justice' next time he gets into trouble. This typically happens to barrio criminals who don't have the sense to go stealing outside their own barrios.

Solution: A shotgun for the home and a small pocket pistol for concealed carry. A couple of dogs for alarm.
