Constitutional Tribunal rules in favor of property owners
The Constitutional Tribunal set a precedent in favor of property owners in the Dominican Republic when it overruled a presidential decree article that had prohibited the eviction of a tenant. The case for violation of constitutional right to property had been presented by Clinica Dominicana (Clinica Abreu).
The higher court ruled that what the present times require is the implementation of reverse policies, so that the right to property ownership is strengthened so as to promote the investment of capitals in housing that can later be rented or sold.
The court upheld an earlier decision of the Supreme Court of Justice but expanded its scope and stated: ?This tribunal considers, the same as the Civil Chamber of the Supreme Court of justice, that the restrictions to the right to property that derive from the application of Art. 3 of Decree 4807, while they were justifiable in the late 1950s and the following years, are no longer justifiable.?
The higher court stated that Art. 3 of the Decree 4807 that prohibits the eviction of the tenant from a property due to the persecution by the owner, unless the rescinding of the contract has been ordered for lack of payment of rent, or for using the rented property for a different purpose than that for which it was rented, when this is in detriment to the owner or contrary to public order or good customs, or due to the tenant subleasing totaling or partially the rented property despite this being prohibited in writing, or for changing the form of the rented property. The decree had ordered that the ruling that orders the eviction of the tenant could not be executed until 15 days after notified.

Ok, for example, you rent your apartment to somebody for 1000 US dollars monthly. He stops paying after a few months. You want to get rid of him, he goes to a court and says that he just lost his job, and he can't pay you $1000, but he agrees to pay something, $100 for example, until he finds a new job. The question is: What will the judge say? The problem is that in DR the judge can say that he is a good guy, padre de familia, his children need to live somewhere, blah blah blah, he is trying to do his best, so he will pay you $100 monthly until he finds a new job and you have no right to evict him. And you can do NOTHING with it.

So, what's new with this decree? How can it help in this kind of situations?

The solution was very simple, DO NOT RENT TO DOMINICANS, only foreigners. Any changes from now on?

ha ha ha the only proper way for foreigners to rent to natives is to see their money,,,,of course a local lawyer overpaid for this one...money coming in money in the bank etc...deposits security collateral... kind of what they want from us...

Even that no guarantee. Where I live, some years ago a renter (not a Dominican, foreign owner of a successful well-known business in Sosua) refused to pay the increase in rent or move out. He continued to make his monthly rental payments to the government bank. Eventually the owner, quite elderly with health problems, sold the apartment at a low price so he could recover something of his investment. With the help of Fabio Guzman, the new owner was able to finally get him out, but when he left he stripped the apartment, including the light fixtures.

I'm happy to see this court ruling.

Not a guarantee either.

Dominican friends of ours rented a place in Las Terrenas to an Italian. He paid rent for one month and soon afterwards one night loaded all furniture and appliances onto a lorry and disappeared for good.
