Santo Domingo.- Assets that have been used to, or intended to hide or mix proceeds from crime, or a product of a wrongful act, even before there has been a ruling to determine criminal liability, will be subjected to a court decision on forfeiture of illicit goods.

The Civil Illicit Asset Forfeiture Law approved by the Senate, and which the Chamber of Deputies is also expected to pass, would allow the forfeiture of properties involved in drug trafficking or other illicit activities, such as organized crime, conviction or not.

A judge will be able to rule for forfeiture to terminate the right of ownership to an asset, whether tangible or intangible, declaring the State ownership and public property.

The ruling of forfeiture “shall be irrevocable, without consideration or compensation for the affected," says Article 4 of that bill.

Here is a quick and humorous summary of how it has worked out in the U.S. over the past several years.

Does this apply to rentals too? I.E. someone rents a building and runs it as a drug point, but doesn't own the building. Can the owner lose it, even if he has nothing to do with what his tenant has done/is doing?

In the U.S. (where the DR law was modeled after), yes. It is an instrumentality used as part of a crime. It is so abusive that there are plenty of stories out there on the Internet of innocent owners losing their homes, cash and cars.
