I believe the OP is looking for a response where it is written in the law. Not the he say, she say, this is what I have always been told response. Most likely the reason for posting in the Legal Forum, looking for a reply from someone who can quote the law.

I just assumed the law would mostly cover illegal things. Doubt there is a law stating that drinking water is legal.

Well that being the case maybe someone can show in the law where it says a third party is illegal?

From the other threads I do believe it is obvious the OP would like something a little more than ……….. well, this is what they always tell me type of answer.

I think the question from the OP in part comes from an interaction with a local policeman explaining why some women walking down the street can be rounded up and thrown in jail for the night.

I know everyone says that. I am asking in the legal forum so that a lawyer in DR can say that. I have been told it is not legal. I have been told it is not illegal either but it is definitely not legal. I would really love to hear what Guzman Ariza thinks.

Legal. Making money as a 3rd party or pimping is illegal.

If there is no law specifically against something, is it legal or illegal? I am fairly certain that is the case with this topic. No law forbids it.

lol seems so. I would just like the debate in end once and for all (the question of if it is legal or not) - by seeing the question answered by a Dominican lawyer respected on these boards.

Art. 334 of the Dominican Penal Code, as amended by Law 24-97 of 1997, states the following:

Ser� considerado proxeneta aqu�l o aqu�lla:

Primero: Que de cualquier manera ayuda, asista o encubra personas, hombres o mujeres con miras a la prostituci�n o al reclutamiento de personas con miras a la explotaci�n sexual;
Segundo: El o la que del ejercicio de esa pr�ctica reciba beneficios de la prostituci�n.
Tercero: El que relacionado con la prostituci�n no pueda justificar los recursos correspondientes a su tren de vida.
Cuarto: El o la que consienta a la prostituci�n de su pareja y obtenga beneficios de �llo;
Quinto: Que contrata, entrena o mantiene, a�n con su consentimiento, una persona, hombre o mujer, aun mayor de edad, con miras a la prostituci�n, la entrega a la prostituci�n, o al desenfreno y relajaci�n de las costumbres;
Sexto: Que hace oficio de intermediario, a cualquer t�tulo, entre las personas (hombres o mujeres) que se dedican a la prostituci�n o al relajamiento de las costumbres o los individuos que explotan o renumeran la prostituci�n y el relajamiento de las costumbres de otro;
S�ptimo: Que por amenazas, presi�n o maniobras, o por cualquier medio, perturba la acci�n de prevenci�n, asistencia o reeducaci�n emprendida por los organismos calificados en favor de las personas (hombres o mujeres) que se dedican a la prostituci�n o est�n en riesgo de prostituci�n.

El proxenetismo se castiga con prisi�n de seis meses a tres a�os y multa de cincuenta mil a quinientos mil pesos.

The law criminalizes the act of pimping in all its manifestations, defining as a procurer or pimp any third party involved in the business of prostitution. It does not criminalize, however, the conduct of the individual, isolated prostitute procuring for herself and having sexual intercourse with a paying partner.

So technically a newspaper selling and publishing a classified ad would be in violation of first, second and sixth article.

Ya. DR1 has it covered:

"Prostitution is technically legal in the Dominican Republic. It is illegal however for a third party (pimp) to have any involvement. In an effort for police to counteract the problem in tourist areas, they will generally arrest any girl who appears to be a prostitute and is walking on the street after dark for loitering. To avoid arrest, the girls simply take a motoconcho taxi directly to the discos and operate from there. If they leave with a client, they will ask him to provide them with the motoconcho fare back to the disco or for him to walk her back himself. If the girl is being escorted down the street by a man, the police will leave her alone. If a prostitute is arrested for loitering, she may spend several days in jail and will generally have to pay the police to be released. She might get this money from a family member, a boyfriend or more likely, another prostitute. Then immediately upon release, she will resume the life she knows."
