Default What Are The Laws For Defamation In The Dominican Republic?

If an Asamblea in a condominium passes a resolution to claim a property owner as 'No Grata' could this be considered an act of libel in written form?

It is making the statement about the character of an individual and to third parties in written form and intended to harm or ridicule the reputation of the individual.

"But defamatory libel can also be a criminal offence. Criminal defamatory libel is any matter published, without lawful justification or excuse that is likely to injure the reputation of any person by exposing him to hatred, contempt or ridicule, or that is designed to insult the person about whom it is published."

Do you not have a solid Dominican lawyer to guide you through things like this? You've been given decent advice and recommendations for counsel on other related matters but don't seem to have resolved them satisfactorily. Why would you think that you'll find better advice here than from a law firm like Guzmán Ariza or one of the other larger firms?

Where have I been given decent advice for counsel here on this board?

Just because a law firm is expensive doesn't guarantee they are going to have an answer for the perverse problems that exist in the country's condominium law.

There are no guarantees but Guzman has specialists in Condo law. There are many other lawyers who are very knowledgeable but good luck finding them with that attitude. You've asked a lot of questions, been told to get a good lawyer and Fabio Guzman himself took the time to answer one of your many questions. You seem to ignore the good advice you've been given. Perhaps you don't really want assistance.

Good luck, you're going to need it.

Things are a lot more complicated than you are making it out to be in your posts. The fact is finding a good lawyer in the country is not as easy as you make it out to be. Do you live in the Dominican Republic?

It really isn't that complicated to an expert and they, unlike you, are (have) specialists who are expert in what you're asking for. No point in being an askhole. You know, when you keep asking for help, get it and then ignore it.

Don't use Guzman but you're a fool if you don't get a good Dominican law firm to assist you. You think it'll be expensive but not as expensive as losing your condo through your own ignorance and arrogance.

It also might be smart to quit attacking those that reach out to assist after you ask. I'm not going to offer anymore or answer your questions.

Sounds like the situation is not getting any better and may in fact be worse. I think at this point you should sell your condo and move. Not necessarily in that order.

Maybe AirBnb it to cover some of the costs of renting elsewhere. Either way, get out before you lose your mind or fall off a balcony.
