A relative with three adult children divorced her husband several years (she's Dominican, he's not and both resided in the US). She bought property in DR with her own funds several decades ago. After the divorce, the ex-husband died and it was discovered that he had cheated and had two children with another Dominican woman.

So now, for her retirement, she would like to sell one of her properties, but needs to know what rights she has to protect her investment. Does she have to give up any percentage of any potential sale to the children born out of wedlock? Can they prevent a sale?

You can imagine the anguish to not only discover such betrayal, but then to also be decimated financially. Thx.

Did she buy the land while they were married? Is his name on the title? Was this land addressed in their divorce?

Yes to all three questions, but it was her funds alone. He did not contribute. And the divorce addresses assets purchased returning completely to the spouse who purchased it.

The wife should file the divorce settlement with the Land Court and ask for the property to be recorded in her sole name. The problem here is that the settlement shoud have specified which properties in the DR should go to which spouse, indicating parcel numbers, etc.; the fact that this hasn't been done will make the matter more difficult.
