Libel and slander

Dear Fabio,
If the press in the DR make an incorrect report, is there any legal remedy?
If an individual makes a slanderous or libellous statement to a private party, is there any legal remedy>
Do you do this work?

You have to prove that the statement is incorrect, you have to prove that the statement was given out false even though they knew 'the truth,' AND you have to prove any damages you had, down to the dollar.

Just for the record...

slander = when someone says things about a person that are false and potentially damaging to that person's reputation

libel = when someone writes things (like in a newspaper column or magazine) that are potentially damaging to that person's reputation

So what is your case?

1) I am a journalist, not the affected party
2) The plaintiff here was libelled in a newspaper. An attorney gave out false information that was printed as truth, without verification.
3) family members are slandering the plaintiff and the plaintiff's representatives.

Law 6132 of 1962 and articles 367 to 377 of the Criminal Code are the legal provisions in the Dominican Republic against slander and libel. Based on these texts, you may have the other party prosecuted in a criminal proceeding.
