Is there a standard Commercial Lease Agreement with a set end date?

I was told that even if there is an end date, the tenant does not have to leave as long as they are paying the rent.

Is there a law that protects the landlord who wants the tenant to leave once the lease is up.

I posted this a couple of weeks ago:

Dominican law is very protective of tenant rights. Eviction of a tenant is only possible in the following causes: (a) failure to pay rent, (b) misuse of the premises, (c) subletting if prohibited by the lease, (d) the owner will use the property. Note that expiration of the lease is not listed. If the tenant keeps paying the rent you cannot evict just because the lease has expired.

Evictions for failure to pay rent are not that difficult. Generally the tenant that?s not willing to pay rent won?t hire a good lawyer either to delay the proceedings.

Evictions under (d) are a long drawn-out process since the first step is a conciliation hearing at which tenants are regularly given months if not years to look for alternative dwelling.

It's applicable to commercial leases.

I have a vacant lot in Naco that one day I would like to build upon. Because of the tenant favored laws in DR, I have kept it vacant for over 6 years. I am getting lots of offers to rent the lot. One of which wants to rent with a contract of two years and they want to have an auto detailing business which would require some temporary structure.

In speaking with the person who wants to rent the lot, I stressed that I would not want to extend the lease for more than two years. If he signs this agreement, would I be able to evict him if he refuses to leave?

Is there a way I can do a background check on the person to see if they had any prior financial problems, etc.

One more: Is it better to rent to an individual, company, US company, etc.

As I said in the post below, expiration of the lease is not among the stated legal grounds for eviction. If the tenant keeps paying the rent you cannot evict just because the lease has expired.

As for background checks, there are several credit agencies (CICLA, Data Credito, etc.) where you can obtain credit reports.

From a legal standpoint, it's irrelevant whether the tenant is an individual or a corporation.

What do you know about the Guzman inheritance, I heard they are about to give part of inheritance by mid december, do you know about it, also heard that there is a limit to complete this process that ends february 2005, if you have any information can you pls let me know, I live in Rep Dom, Santiago
