can you tell me this
i own a block of land which is TOTALLY SURROUNDED by another owners land except for a public access walk/pathway

1/must the owner of this land grant my trucks access to my land for the purposes of construction. This will require my trucks to cross 12 metre of his land.

2/what is the penalty if he does not allow me access to my land for the purposes of construction

3/ as a matter of interest; must ALL property 'by law' have a road access to it. Even though i agreed to purchase this land in a private community. i was just wondering if there MUST be a public ROAD access for me. The problem being that his land surrounds mine and this potential road would eat into his land

I have just answered a similar question below.

You say you are totally surrounded except for a public access walk/pathway, meaning that in fact you are not really landlocked. I assume then that the problem is that the public access is not wide enough for your trucks. Is that correct?
