fiance visa or work contract question?

I was wondering if having two different kinds of visa applications at the us consult at the same time was possible or if it would count against chances of getting approved. my fiance is trying to get a work contract to the usa, but we were also thinking of doing the fiance visa......should we wait to see if the work permit goes thru, or send the fiance visa? any advice would be appreciated

It depends what he's qualified for. You say he's trying to get a work contract in the USA so no point applying unless he has one in his hands.

If you intend on getting married after three months after he arrives in the US then do the fiancee visa.

Either one is a long wait

the thing is someone that he knows is opening a restaurant here in new jersey and want to bring 25 people here from there to work? is that possible or not?

I think he would have to prove to immigration that he absolutely can not find 25 people qualified to work in a restaurant that are already in the US.

Lots of Dominican in that area already. ;)

But let us know if it happens. It would be good info to have handy.

thanks i will let you know, this process started about a month ago, so we are just waiting to hear, he was told maybe by january he will know, but who really knows, so do you think its a bad idea to submit the fiance visa, or should i just wait?

"He" meaning your fiancée was told by his friend right?

If the restaurant owner had it in writing from Immigration it would sound more positive

I may be wrong, but I'm under the understanding that a person can only have one visa/application at a time.

The wait for a fiance visa is currently close to 18 months unless the US State Department brings in more visa specialists to Santo Domingo.

You are quite correct cobraboy. The wait is now 20-24 months. The work visa would be a good deal but as Anna pointed out, you would have to prove that no one from the states qualifies for the job. I might be able to do that here in AZ but in NY, I don't think so. Also, if the Consulate gets wind of the relationship (and they do investigate) that could jeopardize your chances of any visa at all. I'm planning on returning to Santiago in Jan for 3 months. Was hoping to bring Yohanna here on a K1 in the "near future" Do you know if the wait is any shorter for a K3 interview?

Nope, not unless you get married in anothert country. The K3 specifically says it must be handled at the Consulate where the marriage takes place. Read into that what you will but it could mean you could legally avoid the DR waiting list.
