Yes, it is supposed to be. Make sure the seller includes an invoice with the phone so it is not left to the custom inspector 's imagination as to the cost.
Recently I bought a couple of USB hubs on eBay and got stuck with paying duty because the customs inspector thought they must be expensive when the actuall cost was about US$25. No invoice, unfortuntely for me.

Are you talking about ordering online and having it shipped to the DR or bringing it with you through customs at the airport?

how will you get it from Miami to the DR? If you're just bringing one cell phone through customs at the airport, you wont be charged any tarrif..I believe you're allowed to bring 2 or 3 phones with you...

if you bring it through a courier and the cell is less than $200 you will pay no tax. above $200 the tax is 16%. the courier costs up to 200 pesos per lb. if you bring it with you on a plane you pay no tax.

business mail is a business in DR that brings mail and packages from my mail box in Miami, and deliver it to their office here in SD.I then pick it up and pay their postage fee....I get packages all the time but have never ordered a cell phone and was wondering if that item was handled any different than other items....if not, then I will only pay the postage...I am going to purchase a motorola pebl phone for around
$180 for my wife for navidad,.the cheapest here in SD has been around 9000 pesos...so I should save a few bucks...
