Hi all, in May my fiance and I are emigrating to the Dominican Republic. We are both in our 40's and bought a house in Sosua last year. Before we leave we need to fill out Form P85 (Leaving the UK). It's from HM REVENUE & CUSTOMS.
Several questions are concerning us.
We do NOT own a house in the U.K.

1) Which Country are you going to?
1A) Give your address abroad if you know it.
Should we state our address?

2) Are you leaving the UK to work?
2A) If "NO" give your reason for leaving the UK.
Obviously, we want to work and will be working in the Dominican Republic when we have settled.
I was considered just answering 2A "Emigrating".
Will this answer surfice?

I guess we're a bit paranoid of the UK Government trying to take our money when we move to the Dominican Republic. We will not have ANY income from the UK when we move to Sosua.

Any advice would be appreciated.

Don't worry. The govt won't take you rmoney here but they will tax your pension when you get it in the UK. By filling inthe form you will get tax relief on any savings you have in UK, as long as you don't return for (I think) longer than 90 days. The Tax office have a good website and phone service for ex pats so check that out.

Retain your mild sense of paranoia, j&t's future. When we moved here from the UK I retained the services of a UK accountant experienced in expat taxation issues. Through them I applied for UK non-resident status but I didn't tell the tax office anything at all. (I work on a 'need to know' basis ;) ).

There have been recent changes 'from April 2008, expatriates making frequent trips back to the UK will have to carefully plan to ensure their non-resident status is not jeopardised. Expatriates can no longer rely on non-resident status being endorsed purely because they spend less than 91 days in the UK each year.'

By all means read the HMRC (UK tax office) website but more importantly read websites of accountancy companies who specialise in this issue before filling out any forms. If P85 is to reclaim overpaid tax in the current tax year & as the UK tax year goes April to April, my guess is that by leaving in May there wouldn't be much to reclaim.
