That's tough, if one does not have the means. It can turn one's world upside down.Generally, the person and their family/team etc. The embassy may provide some, but that's a case by case deal

You are dead wrong. He is not allowed to leave the Country and being questioned of course he needs a lawyer. I hope you are never in trouble and innocent here. There is no one other than you who would say he does NOT need a lawyer........The guy might not speak a word of Spanish and he desperately needs a good Dominican lawyer that speaks English..............I was talking in reference to NEEDING A LAWYER
YOU NEEDED a Lawyer, as you clearly shot someone , no matter the reason at the time.
Your Innocent Life Saver Student should NOT have needed a Lawyer ..
Since there is no Body, and no murder ..( accoding to you )
I cant believe I have to literally spell this stuff out for you ..
but there it is
I can use larger Fonts if you like ?
He's as guilty as guilty as OJ, but regardless of who you are, a good attorney is mandatory. And in DR one never uses an independent attorney unless you want them paid off to drop the case, because it happens every day.You are dead wrong. He is not allowed to leave the Country and being questioned of course he needs a lawyer. I hope you are never in trouble and innocent here. There is no one other than ;you who would say he does NOT need a lawyer........
If one was low on resources, and had geographic familiarity and spoke the language, you could theoretically stay night by night at a cabaña outside of town limits and eat cold Dominican salami and bread from the colmado, but clearly this kid doesn't have those capabilities. Perhaps his attorneys will source an economic solution for him and his family. That's tough, if one does not have the means. It can turn one's world upside down.
I’d be more worried about him receiving fair treatment by the PN. They love their scapegoats and innocent till proven guilty is not their SOP.
He won't be charged with murder. No evidence of intent. He might be charged with manslaughter like I said earlier...............Don't worry, he's guiltier than OJ
I can't believe this. Agreeing 3 times today. He won't be charged with murder. No evidence of intent. He might be charged with manslaughter like I said earlier...............
Possibly or criminal negligence. Either way it’s an easy way out for the PN and the DR justice system. Justice will be seen to be done and it’s business as usual until another high profile drowning occurs at an AI and the PN dog and pony show starts again. He won't be charged with murder. No evidence of intent. He might be charged with manslaughter like I said earlier...............
Thank you for explaining it to me .. I learn so much here ..You are dead wrong. He is not allowed to leave the Country and being questioned of course he needs a lawyer. I hope you are never in trouble and innocent here. There is no one other than you who would say he does NOT need a lawyer........The guy might not speak a word of Spanish and he desperately needs a good Dominican lawyer that speaks English..............
There are people on these boards with lots of knowledge of the criminal justice system and it's not because they're married to a Dominican lawyer or they went to law school, so there's that post.Thank you for explaining it to me .. I learn so much here ..
Just like other countriesPeople on this board need to know this about the Justice system here. If you involved in a serious matter you can be 100% innocent and be sent to jail for six months preventive custody while they investigate. If you are NOT a Dominican citizen you will NOT get bail. So the idea that if you are innocent you do not need an attorney is like they say in Monopoly "Go straight to jail"........
I agreeAgreed. She and her parents are not Dominican citizens. We know the rule of law in the DR rules in favour of Dominicans. I have no doubt about the final outcome If her body is not located and an autopsy is not performed. The most that will be done is a DR form of public inquiry to give the media the impression justice is being done. The inquiry will be a review of the multi agency response to the incident, it will exonerate resort staff, and praise the DR multi agency response. DR police investigation mistakes will be glossed over or covered up, existing evidence will eventually disappear, and the government party line of CYA will be the end result.
I’m sure the DR police and other agencies are making a concerted effort to find her body while they are being held under a microscope by the US enforcement agencies but, if the US agencies and her parents weren’t here to push them, the DR agencies would have called this off by now and written it off as another tourist drowning due to alcohol. That may actually be the reason but, without a body, we will never know.
No body found and no autopsy also means less likelihood of lawsuits and a long drawn out trial in public view. Something the DR tourism industry would fear because it would be a media nightmare for its AI industry in peak season. Something US media outlets would cover extensively.
They might as well start thinking ahead just in case. I've heard of collusion stories where cases get prolonged as one is bled of their resources - could be fiction or maybe not.Perhaps his attorneys will source an economic solution for him and his family.
Is this 100% guaranteed, or there are ways around it such as having a guarantor and surrendering a passport? If you are NOT a Dominican citizen you will NOT get bail.
Every country has mechanisms to detain people. O.J was locked up until trial, Bill Cosby and even P.diddy who is close to being a Billionaire is/was locked up.They might as well start thinking ahead just in case. Just before this case came up, a Dominicana died in suspicious circumstances in the same general area, somehow the suspect managed to get out of the DR and the coverage has gone cold. No mention of it since https://bavarodigital.net/terrorifi...r-reportada-desaparecida-senalan-a-su-pareja/
Short answer yes, following 18 U.S.C. Section 1119, Foreign murder of United States nationals and 18 U.S.C. Section 1203, Hostage taking. Can he be Extradited back to the US to be Prosecuted back here ?? Since they are both US Citizens .
Tried to look this up and its very confusing, as normally such cases are prosecuted ( adjudicated) where they occur , the DR has Jurisdiction over the case , HOWEVER if they allow him to WALK in the DR , can he be prosecuted a second time in the States ?
Assuming they have the Evidence of course .
Maybe that is why the Parents went back Home . Any trial in the DR , if there ever is one will be a complete cluster F .
Its almost better if the DR Govt lets him Walk .
