Honestly I have not read a lot about the case because I don't understand why so much noise about somebody who got drunk and puked during all her vacation and finally drowned, not a big loss to a society. Would DR Government do a massive search like this if some Dominican goes missing after drinking too much cleren at the local colmado?
No way José. A lot of Domincans drown here on the north coast and i've never heard of any massive search ever being done9/0.
So maybe I missed that part, but did they hold him at all? As I understand, he was continuing spending his vacation in the same resort, and even for free (Government paid for his extended stay), he was under supervision all the time, but can it be legally interpreted as being held? He was not locked in a prison cell.
He was not allowed to leave his room unless he was accompanied by PN. Basically, wasn't allowed to leave the resort either.

DR1 "experts" usually say that you don't really need a lawyer in DR until you are in court. So yes, this guy needed a criminal defense lawyer for his court hearings.

But since when Guzman Ariza became criminal defense lawyers? It's not their area of expertise at all. Probably they got involved because the relatives of the guy did not have time to find somebody else. Or maybe because Guzman Ariza wanted to turn it into advertising of their firm for foreigners, because of the wide publicity of the case, so they were mentioned a lot in the press. They need foreign clients to pay for their overpriced services, and advertising on DR1 doesn't work anymore because there are only a few old expats left on this forum who don't have any money anyway.

So good thing is not that he hired these lawyers, but that they did not fcuk it up, because it's not their area of expertise at all.

Criminal lawsl as you have stated is not a normal area of law for GA but they are well connected. It would be normal to associate with experts in areas outside the norm for either good existing clients or those in need that want the cache of the firm and their connections to make or keep such cliental. It was a smart move to take the case and Garner all the publicity.

No need to have actually dealt with them specifically though many of us have, to see that. "It ain't rocket surgery"

No they would not and in my opinion, they shouldn't have done it for this young lady either.

I think after her parents saw the video of her puking her guts out, they understood everything and that's why they asked DR authorities to stop the investigation and just declare her dead.

I have been to this resort, honestly I don't know how come they don't have cases like this every week, if not every day.

I was also wondering this
His travel was restricted by a form of house arrest and his passport was taken away which restricted his ability to return home. After 48 hours it was illegal according to the DR constitution. I’m not a lawyer. Just my opinion.

If her body had been found quickly, he could have been held longer pending the results of the autopsy to rule out foul play. That’s acceptable

The Pivot airlines crew were never formally charged and held for many months because the police had solid evidence, hundreds of pounds of cocaine seized from the aircraft. The PN also had solid evidence exonerating the crew but they chose to ignore it and then lose it.

If Joshua’s family hadn’t hired a lawyer and US law enforcement agencies weren’t involved, he would probably still be held pending further investigation and not at the resort. He would be in a DR jail cell having his life threatened while being extorted for money by his DR cell mates.

JLS. Taking the high road is respectable and admirable but many times, it’s just pissing into the wind. I’ve learned to always consider the source when I respond to a post I find unpalatable. Something I did a lot back in the days of the OT threads. His so called OP Ed is a rant. Very often a rant is the best laxative for those afflicted with mental constipation.

Sorry but it is not just this resort. If you have been to this resort, then you are aware that stretch of beach is rough. Most resorts in the area (Riu, Hard Rock, Occidental) more times than not have a red flag out. Drinking and going into the rough water is not the best idea. No parent should ever have to suffer a loss like this. Unfortunately, it happens but it does not make it any less tragic. Understanding and accepting are two different things.

Unfortunately, it is not just about spring break. I see numerous stories on travel forums about the same thing, people drinking (drunk) and going into the water. You know that mentality, "it can't or won't happen to me".
