Does anyone know the laws on marriage or divorce in the DR?
My question is... If a man and woman divorce after 3 yrs of marriage is the woman entitled to the mans property, retirement, and savings that he owned BEFORE they married?
What if some of his belongings were from his previous marriage?
Does never having shared a household with the estranged wife bear any weight on the situation?

Anything would be helpful.

I would not help you even if I could. What is it that you are after? Are you a golddigger? Sorry, from what I know, pick up your underwear and go! I always have the right solution for spouses, either male or female, asking too many questions about divorce settlements...a good separation of property document. My lawyer Cesar Estrella Shadala can draft you one that the spouse might be able to leave with the underwear on, only if you want for only $8,000 pesos. This is good as gold in DR.

TW, I hope something like that has not happened to you.
As for me, happily married 12yrs to my high school sweethart.
I'm asking for my father (US citizen) in the DR, retired. Married a Dominican woman and found out she was after his pension and a GREEN CARD. After almost 3yrs of being seperated she now wants my dads home, $15,000 monthly, the car and many other things (which he and my mom purchased a long time ago).
My mother is deceased.
My Dad has been told she is entitled to 50% of it.
TW do you have a phone # for this Shadala lawyer. $8000 seems pretty good to me.

Carabella: Nothing like that has ever happened to me. I have always been wary of spouses anyway. But for those retired foreigners, a word of warning, get yourself a good lawyer before you get married. Better yet, just get yourself a live in girlfriend for a couple of years and then go somewhere else. My lawyers phone is 531-3622,482-6579 and fax 482-6474. Ask for Mr. Pi?eyro or Elias Melgen both specialists in divorces at that firm estrella Sahdala, Pi?eyro Fernandez & Elias Melgen.

The one with the best lawyer wins!Since here the "wife" will have only the clothes on her back, she will not be able to pay for a "real" lawyer.She and her "street lawyer" will accomplish nothing! Don,t worry, pay for a good lawyer.Criss

Distribution of Matrimonial Assets after Divorce

Assuming that no prenuptial agreement exists, the rules for the distribution of matrimonial assets under Dominican law are as follows:

1) Real Estate ("Inmoveable Property")acquired during marriage is divided 50-50 between the ex-spouses, except for real estate inherited by a spouse which will belong 100% to that spouse.

2) All other assets ("Moveable Property"), for example, bank accounts, stocks, bonds, cash, are split 50-50, irrespective of when they were acquired. (As a law professor, I used to ask beginning students the following question: What would be the fastest and cheapest (no taxes!) way to transfer property? The answer: marriage to a spouse loaded with "moveable property").

Of course, the above is just an outline. There are nuances and exceptions that belong in a court of law and not in a public forum for non-lawyers. In any case, you should consult an attorney of your choice to assist your father. Unfortunately, it won't cost him $8000 pesos. Litigation is much more costly than that.

Come on TW, read the damn article!

`It states quite clearly that only those relationships that are "monagamous, developed in public andexclude secret relationships".

Basically, what this does is give some help to common-law wives...not mistresses, which by definition are secret affairs-or supposed to be...

What's the story when the couple

didn't live together for the 3 years of marriage? Wouldn't there be grounds for an anullment? INS wouldn't allow papers.
Just wondering.
