The preliminary report into Fiscal Ceballos' death was handed to Attorney General today. If you scroll down on the link you will see that the Foundation which supports the Public Ministry and the International Federation of Colleges and Associations of Antillean Lawyers has asked for the widening of the investigatory commission to include reps. from Church, National Commission for Human Rights and civil society.

Well, it would appear that the good people of Sosua certainly think so. This piece in today's El Faro makes clear their lack of faith in the official investigation and their fear of speaking out publically because of links between law 'enforcement' and drug traffickers.

There's a second piece which says Attorney General did receive the preliminary report from investigators and is now taking over being in charge of the enquiry himself. The dead Fiscals car went to SD yesterday for examination (why did this take 2 weeks?). This piece also says that the other people in the restaurant haven't had their statements taken. Supposedly Attorney General's report will be ready next week. According to El Faro, residents of Sosua aren't holding their breath,

And note, NOTHING about the request for independent investigation involving people outside the Public Ministry. I hope this doesn't mean they're not considering this; I think the residents of Sosua have been very patient up till now but how much longer will this last?

Attempted attack at home of witness

Someone entered the home of the witness Teresa Acosta this morning, using a ruse to gain entry and subsequently pulling out a toy pistol. Snra Acosta has police protection and the protecting officer fired but didn't hit the assailant. However as the assailant fled neighbours disarmed him and took care of business to the extent that he is now in Ricardo Limardo Hospital in Puerto Plata. Police are investigating, according to El Nacional.

If it was a 'joke' it was in pretty poor taste. Poor woman must have been terrified. I wonder if the police bodyguard had noticed it was a toy pistol when he fired not hitting the perp? Maybe the perp was mentally handicapped? Or maybe it was a way of finding out how on the ball the police protection and neighbours are? In which case, looks like those are some pretty alert neighbours...................

There is more detail in Listin. There seems to be some dispute about whether the pistol was a toy or not, but no dispute over the fact that the assailant is not local but comes from Santiago. The fruit he brought has been sent for testing to see if it was poisoned.

If they did want to "eliminate" her, it sure wouldn't have been to stop her from telling her story, as she has already told it in detail, live on TV.
One might be inclined to believe it would be for revenge, and/or to scare others from talking.

The investigation splits

It appears that the investigation team of 3 Fiscals into Fiscal Ceballos death by shooting will be issuing 2 reports - a majority report by two of them and a minority report by one of them who has split off from the main group. According to a source of El Nacional the main report will say that the weapon which caused the fatality was one with telescopic sights and that this type of weapon was not assigned to any of the police who were part of the group sent to arrest Fiscal Ceballos the night of his death. The Fiscal working alone is Dr. Vielka Calderon, Procuradora General of the Appeal Court in Santiago. She says she just wants to find out the truth and appears to be carrying out a parallel enquiry of her own. Read more here

Meanwhile, the man who threatened the witness Teresa Acosta yesterday is still in a serious condition after neighbours beat him up. Last night doctors decided to do an emergency operation because he was still unconscious. There is a separate report in El Nacional

The incident at Teresa Acosta's house was on national news last night. Looks like a lot of neighbours are forming a protection committee for her, despite the fact that she has police protection ( 3 officers per day each doing 8 hour shifts so one at a time).

If the majority report gets accepted I'm not certain what the reaction of the people of Sosua Abajo will be. All they know is that the Fiscal is dead and seemingly the finger is being pointed at someone other than the arresting police and fiscals.

It points, yet again, to the need for an independent enquiry.

Did I ask in post 27 if perp was mentally handicapped? Close apparently........:paranoid: According to Hoy and El Nacional he has psychological problems due to a history of drug consumption. He also has links to those in the drug business. Although he gave his address as Santiago it would now appear he lives in El Tablon (Sosua). He has recovered consciousness and is still in hospital. Newspaper reports says the gun used was a toy gun. Teresa Acosta, the victim in this matter, has been moved to a safe address. More in the links below.

Report is now out. Very interesting. In brief it says Fiscal was killed by bullet from a DNCD officer (unnamed). Also that Fiscal fired his own weapon 5 times (which conflicts with what witness Teresa Acosta, the TV journalist, said). Investigating commission has recommended suspension of the 2 SD Fiscals in charge of the arrest operation and submitting them to disciplinary action by Public Ministry. The other participants (DNCD & National Police) should be referred to their own organisations for disciplinary action. There is also a recommendation that the case should be submitted to criminal justice because of a contradiction in info received from one official and the actual bullet removed from Fiscal's cranium.

The officer wounded in the killing was wounded by a bullet from dead Fiscal's gun, it says. There is also comment about the two faces shown by the Fiscal, the defender of the public from drug trafficking and someone with intimate connections with perps. It says that dead Fiscal was being investigated for extortion and killing of a known trafficker, Nonon. As well as this there is comment about the intimate links between law breakers and law enforcers in Sosua and Puerto Plata.

This should go someway to mollify the people of Sosua Abajo. It isn't the whitewash which was expected. On the other hand, not accepting the witness's account may not go down too well. Rocky and Sosua folks, any comments? I cannot find any mention of the other fatality........maybe a separate investigation report?
