You are confused. The term "Magistrado", is used to refer to both judges and prosecutors. You can't see a magistrate judge with a "cita". It seems you, or someone you know, might have been involved in some sort of family matter, or perhaps a neighbor dispute, which didn't leave the fiscalia.
Like I've said, this person needs to go to their closest fiscalia and file and complaint. To sum it up, It's the fiscalia who leads the investigation, asks the court for phone interventions, search and seizure, arrests warrants, etc. They request arraignment hearings, and also the preliminary hearing before trial.
