That's the prosecutor's office. That's where you file a complaint.
Um it's not a prosecutor. The first person you see with a cita would be the magistrate. We have what's called law by consejo. The magistrate hears both sides and makes a recommendation to each party. Sometimes it's a stern recommendation. They want both parties to reach an agreement.

The fiscalia houses various legal functions. In a small town there will only be a magistrate. If the case is serious enough they may refer you to the provincial seat.

Well she translated it wrong. Did i commit some forum infringement here? It's not the prosecutors office. That is not 100% correct. And i may know a few things Profe. To your amazement.

I believe the "fiscalia" is the office where you file a complaint. The "fiscal" is the actual person that handles the complaint. In Sosua, the fiscal is in the ayuntamiento.

Yes and there is not someone prosecuting a cita for a complaint. It's a magistrate that will offer a solution and get both parties to agree. That is not prosecution!

Yes. The "magistrate" is called a fiscal here and basically does try to get the parties to come to a solution. The fiscal does have the legal power to file a restraining order, issue some fines, summon to appear, and order arrests. Maybe others(?).

Like I've said, this person needs to go to their closest fiscalia and file and complaint. To sum it up, It's the fiscalia who leads the investigation, asks the court for phone interventions, search and seizure, arrests warrants, etc. They request arraignment hearings, and also the preliminary hearing before trial.

I understand. However there is no "prosecutor" involved in a complaint process. My point was the "Fiscalia" depending on small town vs provincial seat, houses various functions. A prosecutor gets involved once a formal case is established where there is an accuser and and accused. French or British law, no? In small towns the fiscal may be a magistrate function. If they deem the case worthy they would refer up to the main Fiscalia in said province. My point was the "Fiscalia", as a legal function/entity is not merely a "prosecutorial" function.

Of course they're involved. That "Magistrado" you mentioned earlier is a prosecutor. I'm from a small city and usually the same magistrado who received the complaint, was the one who followed up the case and ended up prosecuting it.
Also if they referred the case to the main Fiscalia in the Province It's must be because that's where the seat of Court was too.

I think we're just on semantics now Licenciada. No child support lol, I actually have the custodial sentence for my children. I just happen to have experience within the court system. Life has just worked out that way

Let me be real with you .. your money is gone it will only cost you more money and time its not worth it . let it go chalk it up as a lesson learned here.
you can see if the store has a blog than hammer it with your thoughts.... and they are thieves. your not the first this has happen too

Totally normal all over the world - his so called 'scam' .......
