De oma van de man zegt tegen stadszender AT5 dat hij al zijn hele leven bij haar woont. Zijn ouders zijn zonder hem vertrokken naar het buitenland.

Door een opeenstapeling van fouten heeft de man geen Nederlandse identiteit. Hij stond eerst ingeschreven via het paspoort van zijn moeder. Maar toen zij haar Nederlandse identiteit opzegde, verviel ook die van de man.

Dit werd nooit ontdekt, omdat de oma van Buter hem op advies van de gemeente bij zijn basisschool had ingeschreven met zijn oude burgerservicenummer (BSN), schrijft Het Parool. Als dat destijds wel was ontdekt, dan waren andere regelingen voor minderjarigen van toepassing geweest.

Zijn gebrek aan een Nederlandse identiteit werd pas een probleem toen hij zich wilde inschrijven voor een studie. Begin november kwam de Immigratie- en Naturalisatiedienst (IND) hem ophalen. Daarvoor kwam ook een politiewagen langs.

Man zit in vreemdelingendetentie

Buter zit op dit moment in vreemdelingendetentie in afwachting van zijn zaak, die voor februari op de planning staat. Mogelijk wordt hij uitgezet naar de Dominicaanse Republiek. Dit is het land waar zijn ouders weliswaar zijn geboren, maar niet meer wonen. De rest van zijn familie woont in Nederland.

Familie en vrienden proberen ervoor te zorgen dat de man zijn zaak in vrijheid kan afwachten. De IND was donderdag nog niet bereikbaar voor commentaar, maar stelt bij de stadszender niet in te willen gaan op individuele zaken.

Halsema: 'Daniel hoort niet thuis in detentie'

"Ik heb de berichten gisteren met afschuw gelezen. Ik ben het er ook mee eens dat Daniel niet thuishoort in detentie", zei burgemeester Femke Halsema donderdagmiddag na vragen van GroenLinks. "Het gaat om een Amsterdamse jongen die op dit moment zou moeten studeren."

"We hebben als gemeente een actieve zorgplicht om onze inwoners te helpen als ze verdwaald raken in bureaucratie en regelingen."

Halsema zei te onderzoeken wat er bij de gemeente is misgegaan in deze zaak. Ze heeft contact gezocht met verantwoordelijk staatssecretaris Ankie Broekers-Knol en de Immigratie- en Naturalisatiedienst (IND).

Halsema said to investigate what went wrong with the municipality in this case. She contacted responsible State Secretary Ankie Broekers-Knol and the Immigration and Naturalization Service (IND).

"De IND zal de aanvraag voor een verblijfsvergunning beoordelen en betrokkene mag de uitkomst van zijn aanvraag thuis afwachten."
