What to do if you inadvertently run over a person

I must admit the other day I was in an Uber and he ran a red light, got stopped and the Amet was asking for my ID. No way was I giving it, I wasn't driving, not even in the front of the car. I got the impression that he was more interested in fining the gringa if he possibly could than fining the Uber driver.
This is the reason unfortunately you do NOT stop to help at any accident scene.............

Even though Casa de Conductor has it's own judge and prosecutors, and a person is considered to be "Detained", the father of the girl complained enough that they moved her to another jail

Is casa de conductor tied to the car (insurance) and if so is it valid to everyone driving that car?

Interesting they say she was moved for her own safety. Why was she unsafe in the Casa de Conductor I wonder?

What was the reaction from Amet when you refused?

I said I wasn't driving and he had no right to ask for any of my details as he was a traffic cop. And he said he wanted to see my ID. So I said Let me just call my embassy and speak to a lawyer there. And he said No it's fine you don't need to show me your your ID you weren't driving.

I mistyped BTW, I meant to say the father of the victim. I'm guessing he has lots of contacts in the legal world due to his profession and was miffed she was staying in a hotel.

Once she has her preliminary hearing in a day or two she would have been moved anyway.

It will be interesting to see if she gets detention. We'll see how much influence the father has:

" Lawyer Robinson Reyes dismissed the possibility of a judge imposing preventive detention on Shakie Valentina Mujica Zapata, a Venezuelan accused of the involuntary death of Julio César de la Rosa Peralta in a traffic accident on July 15 on the 30 de Mayo highway.

“Requesting preventive detention for a traffic accident is absurd. The Public Ministry may request it, but no judge will impose such a measure,” Reyes asserted.
Reyes explained that the case involves reckless homicide, highlighting that the victim was seen in videos exiting a vehicle and crossing the road, where he was struck. The accused’s primary fault was not stopping and calling 911 immediately.
The potential sentence for reckless homicide ranges from 6 months to three years. However, Reyes noted that Mujica Zapata would likely not serve jail time, as her sentence would probably be suspended."

If I was on a low traffic road, no one nearby as a witness, and no potential for cameras to capture me, then I'm making a fast exit. Sorry to the person lying on the ground.
Such is the injustice of how Gringos are treated under DR law, that they would consider doing something in violation of the law that they would not consider in their home country.

I was wondering. What happens if your vehicle has a problem, for example you have a tyre blowout and you accidently kill someone. So it is an accident which isn't your fault, but someone dies. Do you still get locked up?

I was chatting about this today, and we agreed Uber and using taxis are way the best bets for foreigners here (at least those of us who live in the capital)
Based on the fact that a DR judge declared a gringo driver guilty even though he was innocent, I don’t think there are any legal mitigating factors for non Dominicans. The judge’s reasoning was the accident would not have occurred if the gringo wasn’t at the scene.

Anytime I rented cars, I opted for the third party liability insurance and was told it would cover all legal costs if I hit a Dominican. I’m glad I never had to use it. Probably wasn’t worth the paper it was written on.

The thing I found shocking yrs ago was you can leave the scene of accident here legally…but must report to police station right away…mob mentality is strong here..only country I know people run to gun fire not away!

the only case I know of a gringo escaping is this military guy he plowed someone questionable if it was his fault but he remain calmed he called the Pentagon and he was out the country within a few hours.

Also robbing injured or dead accident victims of their valuables and their morbid fascination with the carnage at accident scenes and their need to photograph everything and post it on social media. I’ve witnessed it a couple of times.

On a funnier note, I came across an accident between Puerto Plata and Costambar involving an overturned truck carrying cages of live chickens. Dead chickens, feathers and guts all over the road. Live chickens running around. People were running off in all directions with live chickens under their arms. Had to stop and view the free entertainment. My mind flashed back to the WKRP sitcome episode involving the free turkey drop from a helicopter into a mall parking lot. Oh the humanity! 🤣

OK so first call your lawyer. Second your lawyer should immediately call your car insurance company. Even with the Ley Insurance they will send a lawyer to the court where you appear also. So you should have 2 lawyers with you. Residency matters little, but Citizenship does...........

You can expect more than 3 years in jail if you are convicted of killing someone with a car regardless of how it occurred or who's fault it really was. This is another reason I don't drive down here unless I have too.

I can understand that. It is sour the same law that no one respects can easily put you in this guilty until proven guilty position.

I used to drive a lot in the DR but the fun of that is fading.
