Lawyer Jottin Cury (junior) tells El Caribe newspaper that the right to be re-elected, which was incorporated into the Constitution in July 2002, does not apply to President Hip?lito Mej?a, as he was elected under the Constitution of 1994. The Constitution in 1994 disallowed a second consecutive term of office for an incumbent president and Cury cited Constitutional Article 47, which establishes that laws may not be applied retroactively. Former judge Juan Miguel Castillo nevertheless believes that Mej?a can indeed run, saying that the argument of retroactivity would nullify Article 120 that dictates that constitutional reforms cannot be suspended nor annulled by any government power, authority or popular acclaim.
