President Luis Abinader on Thursday, 19 September 2024 introduced to the Senate the bill that seeks to amend the recently created National Intelligence Agency (DNI) under Law No. 1-24. The proposal aims to clarify and strengthen the constitutional framework of the intelligence agency, according to a statement from the Presidency.<\/p>\n\n\n\n

The bill, presented by legal advisor Antoliano Peralta, comes after a working group comprised of government officials, representatives of newspaper companies and civil society representatives reached a consensus for changes to the law as previously passed in the ruling Modern Revolutionary Party (PRM) congress.<\/p>\n\n\n\n

The proposed changes focus on Articles 1, 2, 9, 10, 11, 26, and 32 of Law No. 1-24. Key modifications include:
\u2022 Merging Articles 1 and 2: This would create a new Article 2 that defines crucial terms such as intelligence, strategic intelligence, military intelligence, criminal intelligence, open sources, and closed sources.
\u2022 Strengthening coordination with Indotel: The bill seeks to enhance cooperation between the DNI and the Dominican Institute of Telecommunications (Indotel) to better protect user privacy.
\u2022 Judicial authorization for data collection: The proposed amendments would require judicial authorization for any procedure that limits constitutional rights, particularly regarding the collection of information from closed sources.<\/p>\n\n\n\n

The Presidency emphasized that the bill addresses concerns raised about Law No. 1-24 and aims to align the nation’s intelligence system with constitutional provisions.<\/p>\n\n\n\n
