I would really appreciate some help.

I am a UK citizen. I got married in the Dominican Republic. My husband and I have been separated for 4.5 years and we have been living in separate countries. He has been living in the Dominican Republic and I in the UK.
Questions:
1) Does he have to consent to divorce?
2) or can I get a divorce regardless because we have been physically separated for 4.5 years?
3) Is our marriage valid in the UK?

First question is where do you plan on petitioning for the divorce? And go from there Dominican requirements are different than those in the UK. Need to be more specific. If planning on getting divorced in the DR ask Guzman cause most answers will be speculation

my lawyer in Puerto Plata got me a divorce a few years. It was quick easy and not very expensive. She said at the time I didn't

That should be found out first.
If it was not legalized, you are not married for GB law.
No separation needed then, I think... :classic:

I had planned on divorcing in the DR since we married in the DR. No I did not get our marriage legalised in the UK. donP, I think you are right I ought to find out if our marriage is valid in the UK first, but even if it is not valid, would I still need to divorce him in order to marry someone else in the UK? I am not sure whether I need to be asking these questions to a lawyer in the DR or the UK?

I just reread your reply. It would be good news if I am not recognised as being married by the UK law. I will contact a lawyer here to get that confirmed. I would still feel like a polygamist if I were to marry without divorcing my husband in the DR first though. Well I guess the law is the law regardless of how it feels.

Tish, DR marriages are recognised in the UK even if you did not register them there. You need to get divorced in the DR to be able to marry in the UK again. It is not difficult, takes around 4 months, not that expensive either. I sent you a pm.

Also if I didn't divorce my husband in the DR, he then wouldn't be able to remarry someone else.

DR marriages are recognised in the UK even if you did not register them there.

True, but it also depends whether the Dominican marriage was properly administered.
I know of cases where that was not done and thus not fulfilled the (German) requirements.

So, it may help to refer to the papers issued.

If you have property and you want to divorce, it takes a hell of time and also 20 % of your assets on both side for lawyers fees.

tish, unless they caught a non Dominican fish the vast majority of Dominicans do not bother getting married. They move in together and when one or the other gets caught cheating the man moves out and she gets the furniture and the kids. He pays nothing and goes his way. Go back and get a cheap DR divorce and it will end the headache. Plus you get a little vacation.

In the United States my daughter was able to divorce her Dominican husband without informing him, since she had no address for him. Unless he contacts her, he will not know that he is divorced, and he will not be able to remarry in the Dominican Republic. (If and when he does find out, he will stay have to pay to have the divorce registered in the D.R.)
