I am in need of a copy of a power of attorney from DR. My grandmother (my maternal grandmom) pasted away 6yrs ago and left a home in Santiago in the care of an attorney because my mom, and my uncle who were the original owners have passed away. The only living relative is my aunt who is 50+ and lives in DR, and us her 5 grandkids which i am the eldest all live in the US and do not visit DR. We all have felt that thru out the years this lawyer has not been totally honest with us. None the less he sold the house and claims that the laws in DR say the profits from the sale of the house were only about $8,000 american dollars and by DR laws he has to divide it between all 6 of us the living daugther and grandkids, IS THIS CORRECT??
why if my aunt is the only living daughter and lives in DR should we as grandkids be included??? and we do not want any monies we want her to have it all. I spoke to this attorney and he says we all need to go to DR to get our share and give it to my aunt, or hire another attorney in DR to tell him to give her the monies(which we can not do or afford to do) or last thing we all need to send him some sort of "PODER, DOMINICANO", with our passport #'s , which 3 of us do not have passports, and give him permission to give her all the monies we are due. HOW DO I GET A COPY OF A POWER OF ATTORNEY FROM DR THAT HE NEEDS SO HE DOES NOT Rip my aunt off and keep all the money... None of us can travel to DR, and she is ill and really needs this money. If anyone can help I would really appreciate it thanks... God Bless...

PODER is obtained from your nearest DR Consulate

The only place you can get a PODER in the US is at a DR Consulate. The last one I obtained was from the one in Philadelphia, but I know that there are Consulate offices in Boston, DC and NYC. To find one just go to the DR Government WEbSite of a list and locations - INDEX-ENGLISH
Please note these people are no different than the lawyer you speak of so go prepared and do not sign any thing that is not clear and understood. Based on what I have learned over the years (and I am not a lawyer ) from this site and personal experience, it would seam that the sale of the property could not take place with out your permission as I understand it the lawyer is correct that you each have an equal share under the law and all must agree for the transfer sale for it to be legal. Good Luck! Note: land value their is increasing, I have no information on the property but the $ seem to be low, do not sell your family short.

If your grandmother had three children, the three of them will inherit equal shares in her estate. If two of them have passed away, their grandchildren will get their respective shares.
