President Abinader presents plan to regulate media

During the Monday, 8 April 2024 press meeting, President Luis Abinader presented to the nation the Bill on Freedom of Expression, Audiovisual Media and Digital Platforms that seeks to update current legislation on freedom of expression. The draft law would replace Public Expression Law 6132. It would create the National Communications Institute (Inacom) that would replace the National Commission for Public Entertainment and Radio.

The bill contains provisions to regulate audiovisual and social media platforms. As of the past governments of Leonel Fernandez in 1996, Dominican governments have become the main source of revenues for media and journalists in the Dominican Republic, with government heavily funding advertising, propaganda, sponsorships and appointing journalists in government.

It would be interesting to see if it will affect Dominican media content on digital platforms such as Youtube. Up to now, the argument has been that Youtube is actually based in the USA, so any Dominican content there is governed by the laws of the USA and not the DR. That argument has been used by Alofoke and others to justify their use of language that are actually sanctioned in the DR.

While they have been able to get around reactions of the National Commission for Public Entertainment and Radio in its attempt to censor some of their language alleging that it’s content uploaded to Youtube, reality is anything made in the DR is subjected to Dominican rules. Youtube simply is the source where the content is stored and made public, but the actual content is made in the DR. Also, much of the content they upload to Youtube is consumed by audiences living in the DR. I equate this to something happen while one of Alofoke programs is in air. Will Alofoke depend on US law enforcements/hospitals/etc if they need to ask for help (call 911) or will it be on Dominican ones?

Regardless what Alofoke et al says, they are in the DR and when in the DR you are subject to the laws of the DR. In addition to that, Youtube never becomes the owner of whatever content you upload in their format. Ownership always remain with the content creators, in this case Alofoke domiciled in the DR.

Lastly, Alofoke as a formal company pays taxes. To whom do they pay most of their taxes, to the DR government or to the USA government?

You can’t have your cake and eat it too.

Word is Abinader is flying in top members of the US administration along with Mark Zuckerberg and Sundar Pichai to show the DR how to set it all up
