Good morning fellow posters. I attended an arranged meeting with a good friend and his lawyer yesterday at the dept of immigration, where he is going through the application process for residency, his first application. Didn't go well as his lawyer advised that his application could not be processed as he is here on Island, and would need to apply for a "visa" in the UK, then comeback here and make the application, hence anyone know the current regulations or confirm whether or not the new regulations muted last year are now being enforced.

a) Do you need to be outwith the Country to apply for a visa to start the process of residency ?

On a similar matter, what is the process for applying for work permits for supervisory roles short term say 6 months to 1 year, ie, application, cedula requirement, national insurance registration for deduction of Tax and NI etc. any ideas on typical costs. It was thought that residency would be simpler, but if the guys need to return to Canada or the UK for visas from their current location in NAssau, Bahamas, it makes things difficult.

Thanks in anticipation.

YES unless you qualify to do it from within the country, which very few do. He would need to go back to his country of origin, apply for a residency visa, then come and deposit the papers for his residency application within 60 days.

There was temporary amnesty on applying for residency without going back to your home country, but that window shut a while ago.

What are the few exemptions that would allow someone to do it from within the country?

I actually know of people getting their residency visas from within the country. Obtaining a residency visa has become difficult as they are getting stricter about applying the regulation that limits who qualifies, however they are granting residency visas to applicants who are already in the country.
