Supreme Administrative Court rules in favor of consumers
The Supreme Administrative Court has given the Dominican Telecom Institute (Indotel) 30 days to review the contracts of telecom companies to eliminate clauses that violate the rights of consumers. The court accepted a petition from the Press and Law Foundation (Fundacion Prensa y Derecho). It ordered the telecom companies to send the contracts to Proconsumidor for revision. These are the contracts that consumers need to sign to receive telecom services. The ruling 447-2013 is dated 22 November and was signed by judges Rafael Ciprian, Mildred Hernandez Grullon and Evelyn Torres. The recourse was submitted by lawyer Namphi Rodriguez for the Fundacion Prensa y Derecho on 3 October. He claimed that the telecom companies included abusive clauses in the telecom contracts. The ruling affects contracts signed by Orange Dominicana, Claro-Codetel, Wind Telecom, Viva and Tricom. The companies were represented by lawyers Olivo Rodriguez Hertas and Flavio Dario Espinal. The Fundacion was represented by Juan Antonio Delgado, Namphi Rodriguez, Belen Felix, Roman Jaquez and Jovany Matos, as reported in El Caribe.
