Ok read through the posts no help. My husband is Dominican and is in Dr. I came to the US to give birth and now have a newborn son, and need to get a passport for him. How can I get one if in the US you need both parents present to obtain a passport for a child under 14, and my husband is currently in DR and am in the states.

You have a problem.
I would suggest traveling back to the DR and going through the American embassy once you are there. You're right. You both need to be present.
You will need a letter from your husband giving you permission to take your child out of the US as well. Make sure you have a birth certificate before doing so.

This is a US government issue, not Dominican Republic related.

Browse through http://travel.state.gov/passport/fri/pubs/pubs_854.html

Probably you will find answers to the US requirements for getting a passport for a baby there.

notarized letter

You might just need a notarized letter from your husband stating he gives you permission to obtain a passport. If he can do this or something else through the US Embassy its better.
Best to so is ask at the Post Office. Make sure you tell her your citizenship and the fathers citizenship. Is he a legal US resident? Let her know.

Good Luck!

You should contact the DOminican embassy in Washington D.C. THeir tel. is 202-332-6280. They should be able to help you with all of that information. I am sure you aren't the first person this has happened to.

I am a legal US citizen and he is a legal Dominican Republic citizen. I was thinking maybe a statement of consent stating that his father is in DR therefore he cannot be present to sign. maybe with a copy of his passport and cedula?

Here is what you do

Forget anything Dominican, as Dolores has said, this is a US government issue, not DR.

So, you hubby goes to a lawyer, has a letter written up saying that he cannot be present but that he approves of you having a passport issued for his son.
If you'll wait an hour or so, I'll post a copy of what he gave to his wife in the US so their son could be issued his own passport.

This is not a big deal

Back later with the answer.
