I posted here, not sure it shouldn't have gone in the legal.

I am about to rent a shop I have in SD. The lawyer (my lawyer) tells me he will deposit the 2 month deposit in the Banco Agricola. I know this is what the law says but I have never done this (I used to cash in the deposit because when tenants leave they always leave with a debt.

Questions:
- what if I don't put the money at Banco Agricola?
- is it standard procedure that the lawyer does the deposit himself at BA?
- what is the procedure when the tenants leave?

Thanks,

Barnab?

Maybe you should have posted this in the legal section. I would be interested to in the answers from the legal experts.

Here is the "Street Smart" proceedure.
YOU,,NOT the lawyer gets the deposit!!!( he/she would most likely keep the money anyway!)
As you said, the tennent will more than likely,"Live Out",the deposit.
You can always deposit the "Deposit" in the "BA" later if there is any kind of legal problems.
You just need to show the deposit slip if you ever have to go to court to be covered.
A friend of mine did that after four years.
He was evicting a tennent.
No problems.

Yes, that's what I figured, process looks too complicated if the tenients leaves out..
