Verdict favors damaged apartment owners

The courts have ruled that the Mormon Church and two building companies (Constructora Caralva S.A and J.A. Caro Alvarez & Asociados) must pay RD$3 million and legal fees to the owners of an apartment near the church. The court judgment is in favor of Enrique Lambertus and his wife Adela Mieses Devers who proved in court that excavations for the large church caused damage to their apartment. The judgment is important because it sets a precedent for other cases underway in the courts. The most notable case is that of some 48 families living in the Residencial Yaris who claim damages caused by construction of the Malecon Center.
