Supreme Court to look at 10% tax

Several business organizations and policy institutions have taken the case of the new 10-percent surcharge on imports to the Supreme Court, in the hopes the court declares Decree 139-03 null and void. The suit is being sponsored by such groups as the FINJUS (Foundation for Institutionalization and Justice); CONEP (the National Counsel of Private Business); the National Association of Private Business; the National Association of Young Entrepreneurs; the Father Juan Montalvo Center for Social Studies; Civil Participation; and the Santo Domingo Chamber of Commerce, among others. The chief complaint regarding Decree 139-03 is that it is in breach of the constitution, which bestows the power to mandate taxes exclusively to Congress and not to the Executive Branch. Nonetheless, today?s headlines in Hoy?s economy section say that the government has already begun collecting the 10-percent surtax on certain imports. The Hotel Association (ASONAHORES) says that this will adversely affect the tourism industry.
