The Sixth Court of Instruction of the National District has freed two men who had been arrested on drug charges. The court’s decision was based on Article 95 of the Penal Code, which prohibits mistreatment of people under arrest. Both men were beaten by DNCD agents after their arrest. Magistrate Clara Luz Almonte rejected the prosecutor’s request for remission to preventive custody for Jose Delio Liranzo Francisco and Juan de Jesus Soto based on the fact that article 95 of the Penal Code Procedures requires detainees to be treated with “dignity” or otherwise any action is nullified. The judge also cited Article 26 of the Code that refers to the procedures for obtaining evidence. Mr. Liranzo Francisco was in possession of small amounts of marijuana and crack cocaine, while Mr. Soto was carrying two crack packages weighing 72 grams in one of his shoes. Both men were arrested as they walked down Jose Marti Street in the Villa Maria sector of the National District. Both men presented the court with medical reports confirming that they had been beaten.
