Danilo promulgates tax amnesty law

On Sunday, 9 December 2012 the Executive Branch promulgated the Tax Amnesty Law for the Strengthening of the Tax Capacity of the State, Fiscal Sustainability and Sustained Development that grants facilities for bringing pending tax arrears up to date. The proposal declares the persecution and punishment of tax evasion and fraud to be a high priority. It was fast-tracked through the PLD-majority Senate and Chamber of Deputies.

The new legislation covers Income Tax, the tax on the Transfer of Industrialized Goods and Services (ITBIS), Inheritance taxes, Real Estate taxes, Property Transfer taxes, taxes on Assets applied to Real Estate and also includes the interest, surcharges and penalties relating to the import of goods.

According to the law promulgated by President Danilo Medina, which carries the number 309-12, within six months the tax administration will present National Congress with a rough draft of the law that speeds up and strengthens the preventive, control and punitive measures for violators of the tax system.

Anyone wishing to benefit from the amnesty for the ITBIS and the Income Tax has a 60-day deadline, after the new law enters into effect, to formalize their request with the local tax office or the main office of the General Directorate of Internal Taxes (DGII). The application should include the taxpayer’s type of economic activity as well as the location of the business or property.
