The Institutionalism and Justice Foundation (Finjus) has suggested that the current status of the National Drug Control Agency (DNCD) is not only unconstitutional but should also be redesigned and placed under the Attorney General of the Republic. Finjus executive vice-president Servio Tulio Castanos is suggesting this change on the grounds that the DNCD had little or no role to play in some of the latest major drug seizures. With regard to the legal status of the drug agency, Castanos says that since the approval of the new Constitution in 2010, the agency is actually unconstitutional, since it is a law enforcement agency and law enforcement is the area under the aegis of the Attorney General. Castanos told El Caribe that “only the intelligence agencies know why they were left out, since at certain times the institution (DNCD) has been known to be infiltrated.”
