In a ruling issued yesterday, Wednesday 18 September, Judge Rafael Delfin Perez of the First Hall of the Civil and Commercial Chamber of the First Instance Court of the province of Santo Domingo prohibited both government and the private sector from carrying out any action that degrades or reduces the ecosystem, biodiversity, flora or fauna of the National Park Mirador of the Springs of Cachon de la Rubia. He recognized that this is a protected area, including its buffer area, as set out in Art. 3 of Dcree 207-02 issued on 20 March 2002.
The decision goes against the decision of the Presidency of the Republic, the ministers of the Presidency of Public Works and Environment, the National Housing Institute (INVI) and the Dominican Municipalities Federation. The court rules against the decision to relocate 15,000 people who live in slums in La Barquita and Los Mina to the environmentally sensitive Cachon de la Rubia area.
