Colombian brothers Huber Oswaldo Buitrago Ruiz and Angel Maria Buitrago Vacca have been taken from their cell at the Palace of Justice in Santo Domingo and moved to the jail in Najayo under strict security measures. They had been arrested for ties to drug trafficking. The warrant for their arrest was made on the grounds of using forged identity to enter the Dominican Republic.
Prison Police arrived at the Palace of Justice at 7am yesterday, Tuesday 24 September for the transfer even though National District Judge, Jose Alejandro Vargas had stated that they should be freed after rejecting a request for preventive custody by the public prosecutor.
Francisco Dominguez, lawyer for Huber Oswaldo Buitrago Ruiz said the transfer was tantamount to a kidnapping and that it violated the release order. He went on to say that he would be appealing on the grounds of habeas corpus to try and obtain his client’s release as he was under arrest illegally and his constitutional rights had been violated.
He said that the judge had granted them their freedom the previous evening, Monday, 23 September so they should have been freed immediately, but the authorities had taken them to another jail without the appropriate person being there to issue the release documentation.
